Conditions or Reasons for Planning Application - CB/15/00275/OUT
Conditions or Reasons:
1) No development shall take place until approval of the details of the appearance, landscaping, layout and scale of the development (herein called 'the reserved matters') has been obtained in writing from the Local Planning Authority. The development shall be carried out in accordance with the approved details.

Reason: To comply with Part 3 Article 6 of the Town and Country Planning (General Development Procedure) Order 2015.
2) Application for the approval of the reserved matters shall be made to the Local Planning Authority within three years from the date of this permission. The development shall begin not later than two years from the final approval of the reserved matters or, if approved on different dates, the final approval of the last such matter to be approved.

Reason: To comply with Section 92 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
3) Prior to the construction phase of the development, notwithstanding the details submitted with the application, details of the materials to be used for the external walls and roofs of the development hereby approved shall have been submitted to and approved in writing by the Local Planning Authority. The development shall thereafter be carried out in accordance with the approved details.

Reason: To control the appearance of the buildings in the interests of the visual amenities of the locality.

4) No development shall take place until a landscaping scheme to include all hard and soft landscaping and a scheme for landscape maintenance for a period of five years following the implementation of the landscaping scheme have been submitted to and approved in writing by the Local Planning Authority. The approved scheme shall be implemented by the end of the full planting season immediately following the completion and/or first use of any separate part of the development (a full planting season means the period from October to March). The trees, shrubs and grass shall subsequently be maintained in accordance with the approved landscape maintenance scheme and any which die or are destroyed during this period shall be replaced during the next planting season.

Reason: To ensure an acceptable standard of landscaping.

5) The development hereby permitted shall not be occupied until a scheme for the parking of cycles on the site has been submitted to and approved in writing by the Local Planning Authority. The scheme shall be fully implemented before the development is first occupied and shall thereafter be retained for this purpose.

Reason: To ensure the provision of cycle parking to meet the needs of occupiers of the proposed development in the interests of encouraging the use of sustainable modes of transport.

6) Prior to the commencement of the construction of the dwellings hereby permitted a scheme for screen fencing or screen walling shall be submitted to and approved in writing by the Local Planning Authority. The approved scheme shall be fully implemented before the development is first occupied or brought into use and shall be retained thereafter.

Reason: To safeguard the amenity and privacy of residents and in the interest of the visual amenity of the area.

7) Prior to the commencement to the construction of new buildings, details of integral bird boxes to be incorporated within the proposed dwellings shall be submitted to and approved in writing by the Local Planning Authority.  The development shall be carried out in accordance with the approved details before the dwellings are first occupied and the bird boxes shall thereafter be retained.

Reason: To create opportunities for biodiversity within the development.

8) The details required by Condition 1 of this permission shall include an updated Badger Survey as recommended by the Ecological Survey by Philip Irvine dated December 2014. The scheme shall then be carried out in accordance with the recommendations of the survey.

Reason: To ensure the protection of badgers prior to construction.

9) No development approved by this planning permission shall take place until a remediation strategy that includes the following components to deal with the risks associated with contamination of the site shall each be submitted to and approved in writing by the Local Planning Authority:

A preliminary Risk Assessment (PRA) including a Conceptual Site Model (CSM) of the site indicating potential sources, pathways and receptors, including those off site.
The results of a site investigation based on (1) and a detailed risk assessment, including a revised CSM.
Based on the risk assessment in (2) an options appraisal and remediation strategy giving full details of the remediation measures required and how they are to be undertaken. The strategy shall include a plan providing details of how the remediation works shall be judged to be complete and arrangements for contingency actions. The plan shall also detail a long term monitoring and maintenance plan as necessary.
No occupation of any part of the permitted development shall take place until a verification report demonstrating completion of works set out in the remediation strategy in (3). The long term monitoring and maintenance plan in (3) shall be updated and be implemented as approved.

Reason: To protect and prevent any pollution of controlled waters from potential pollutants associated with current and previous land use in line with National Planning Policy Framework (NPPF), paragraphs 109, 120, 121 and Environment Agency Groundwater Protection: Principles and Practice (GP3).
9) No development approved by this planning permission shall take place until a remediation strategy that includes the following components to deal with the risks associated with contamination of the site shall each be submitted to and approved in writing by the Local Planning Authority:

The results of a site investigation based on (1) and a detailed risk assessment, including a revised CSM.
Based on the risk assessment in (2) an options appraisal and remediation strategy giving full details of the remediation measures required and how they are to be undertaken. The strategy shall include a plan providing details of how the remediation works shall be judged to be complete and arrangements for contingency actions. The plan shall also detail a long term monitoring and maintenance plan as necessary.
No occupation of any part of the permitted development shall take place until a verification report demonstrating completion of works set out in the remediation strategy in (3). The long term monitoring and maintenance plan in (3) shall be updated and be implemented as approved.

10) If, during development, contamination not previously identified is found to be present at the site then no further development (unless otherwise agreed in writing with the Local Planning Authority) shall be carried out until the developer has submitted a remediation strategy detailing how this unsuspected contamination shall be dealt with and obtained written approval from the Local Planning Authority. The remediation strategy shall be implemented as approved.

Reason: To protect and prevent any pollution of controlled waters from potential pollutants associated with current and previous land use in line with National Planning Policy Framework (NPPF), paragraphs 109, 120, 121 and Environment Agency Groundwater Protection: Principles and Practice (GP3).
11) Development shall not begin until a scheme for surface water disposal has been submitted to and approved in writing by the Local Planning Authority. Infiltration systems shall only be used where it can be demonstrated that they will not pose a risk to groundwater quality. The development shall be carried out in accordance with the approved details.

Reason: To protect and prevent any pollution of controlled waters from potential pollutants associated with current and previous land use in line with National Planning Policy Framework (NPPF), paragraphs 109, 120, 121 and Environment Agency Groundwater Protection: Principles and Practice (GP3).
12) Piling or any other foundation designs and investigation boreholes using penetrative methods shall not be permitted other than with the express written consent of the Local Planning Authority, which may be given for those parts of the site where it has been demonstrated that there is no resultant unacceptable risk to groundwater. The development shall be carried out in accordance with the approved details.

Reason: To protect and prevent any pollution of controlled waters from potential pollutants associated with current and previous land use in line with National Planning Policy Framework (NPPF), paragraphs 109, 120, 121 and Environment Agency Groundwater Protection: Principles and Practice (GP3).
13) The dwellings hereby approved shall not be occupied until details of the bin storage and collection areas have been submitted to and approved in writing by the Local Planning Authority and the bin storage/collection areas have been implemented in accordance with the approved details. The bin storage and collection areas shall be retained thereafter.

Reason: In the interest of amenity.

14) Any subsequent reserved matters application shall include the following:

Estate roads designed and constructed to a standard appropriate for adoption as public highway.
Vehicle parking and garaging in accordance with the councils standards applicable at the time of submission.
Cycle parking and storage in accordance with the councils standards applicable at the time of submission.
A Construction Traffic Management Plan detailing access arrangements for construction vehicles, routing of construction vehicles, on-site parking and loading and unloading areas.
Materials Storage Areas.
Wheel cleaning arrangements.

Reason: To ensure that the development of the site is completed to provide adequate and appropriate highway arrangements at all times.

15) Prior to commencement of development full engineering details of the access arrangements shown for indicative purposes on plan PL-001 shall be submitted to and approved in writing by the Local Planning Authority and no dwelling approved under any subsequent reserved matters application shall be first occupied until such time as the agreed works have been implemented.

Reason: To ensure the provision of appropriate access arrangements and associated off-site highway works in the interests of highway safety.

16) The plans to be submitted in accordance with Condition 1 of this permission shall include a tree survey carried out in accordance with BS5837 2012 which shall identify the location of all trees on and adjoining the land, together with the species of each tree.

Reason: To enable the layout, including the siting of buildings to be considered in relation to the existing trees.

17) The development hereby permitted shall not be carried out except in complete accordance with the details shown on the submitted plans, numbers PL-001 & PL-101, except as may be amended by the subsequent approval of reserved matters.

Reason: To identify the approved plans and to avoid doubt.
