Conditions or Reasons for Planning Application - MB/02/00378/FULL
Conditions or Reasons:
1) The development hereby approved shall be commenced within five years of the date of this permission.

Reason: To comply with Section 91 of the Town and Country Planning Act 1990 which is designed to ensure that a planning permission does not continue in existence indefinitely if the development to which it relates is not carried out.
2) All hard and soft landscape works shall be carried out in accordance with the approved details. The works shall be carried out prior to the occupation of any part of the development or in accordance with a programme agreed in writing with the Local Planning Authority.

Reason: In order to ensure that the planting is carried out within a reasonable period in the interest of the visual amenities of the area.
3) Details of surface water drainage for the site shall be submitted to and approved by the Local Planning Authority before any work on the site commences. The drainage works shall be constructed in accordance with the approved plans before any part of the development is brought into use.

Reason: To ensure that adequate surface water drainage is provided to prevent water pollution and flooding.
4) Before the premises are occupied all on site vehicular areas shall be surfaced in a manner to the Local Planning Authority's approval so as to ensure satisfactory parking of vehicles outside highway limits. Arrangements shall be made for surface water from the site to be intercepted and disposed of separately so that it does not discharge into the highway.

Reason: In order to minimise danger, obstruction and inconvenience to users of the highway and of the premises.
5) Prior to the commencement of any development, a scheme for the provision and implementation of pollution control shall be submitted and agreed in writing with the Local Authority. The works/scheme shall be constructed and completed in accordance with the approved plans.

Reason:- To prevent the increased risk of pollution to the water environment.
6) All HGVs visiting the site in connection with the development proposed shall not use Newton to access the site. Vehicular access shall be taken from Sutton Road.

Reason:- In order to protect the amenities of local residents.
7) All refrigerated units parked on the site between 2000 and 0700 hours shall be sited on the new hardstanding the subject of this approval and located approximately 26 metres to the west of the existing haulage building .

Reason:- In order to protect the amenities of nearby residents.
8) No development shall commence until a detailed timetable for the provision of the new yard area, wash bay, removal of the existing wash bay, removal of the diesel tanks, and implementation of landscaping has been submitted to and approved by the Local Planning Authority. The development shall be implemented in accordance with the approved timetable of works unless otherwise agreed in writing with the Council.

Reason: In order to protect the amenities of nearby dwellings.
9) No part of the land to the west of the line marked A-B on plan no. 5B shall be used for the parking, or repairing of HGVs or any purpose in association with the haulage use other than in respect of the turning of vehicles.

Reason: In order to protect the amenities of nearby dwellings.
10) No development shall commence until details of the new gates have been submitted to and approved by the Local Planning Authority. The development shall accord with the approved details.

Reason: In order to protect the character of the area.
11) The new yard area the subject of this approval shall only be used for the parking of vehicles.

Reason: In order to protect the character of the area.
12) No equipment, goods, waste or other materials shall be deposited or stored in the open outside the buildings on the site.

Reason: To safeguard the character and appearance of the site and the surrounding area.
13) Details of any floodlighting shall be submitted to and approved in writing by the Local Planning Authority before that part of the site is brought into use.

Reason: To protect the visual amenities of the site and its surrounding area.
14) No development shall commence until a wheel cleaning facility has been provided at the site exit in accordance with a scheme to be submitted to and approved in writing by the Local Planning Authority. The wheel cleaner shall be removed from the site once the bund has been completed in full.

Reason: In the interests of the amenity and to prevent the deposit of mud or other extraneous material on the highway during the construction period.
