Conditions or Reasons for Planning Application - SB/03/01567
Conditions or Reasons:
1) The development shall begin not later than five years from the date of this permission.
REASON: To comply with Section 91 of the Town and Country Planning Act 1990.
2) Before development begins, including any ground clearance or excavation, substantial protective fencing, the details and exact location of which shall first be approved in writing by the District Planning Authority, shall be erected and the fencing shall be retained at full height and extent until the development is substantially completed. No materials shall be stored or deposited and no mixing of materials shall take place within the area so protected.
REASON: To protect the trees so enclosed in accordance with Section 8 of BS 5837 of 1991 or as may be subsequently amended.

3) All trenches required in connection with the construction of the access road, footpaths, sewers and any other services serving the development shall, where they pass under tree canopies, be hand dug. Advance notice of the commencement of any such trenching works shall be given to the District Planning Authority in writing.
REASON: To safeguard existing trees and hedgerows.

4) Before development begins, samples of the materials to be used for the external walls and roofs of the new dwelling shall be submitted to and approved in writing by the District Planning Authority.
REASON: To control the appearance of the dwelling.
(Policies 10, B.S.P.; BE11, H9, S.B.L.P.; BE8, H8, S.B.L.P.F.R.D.).
5) The development shall only be carried out in complete accordance with the approved plans and specifications.
REASON: To ensure no variation from the approved plans.
(Policies 10, B.S.P.; BE11, S.B.L.P.; BE8, S.B.L.P.F.R.D.).
6) Notwithstanding the provisions of Part 1 Class E of Schedule 2 to the Town and Country (General Permitted Development) Order 1995 (or any order revoking and re-enacting that Order with or without modification), no buildings or other structures shall be erected or constructed within the curtilage of the property without the grant of further specific permission from the District Planning Authority.
REASON: To control the development in the interests of the amenities of the area.
(Policies 10, B.S.P.; BE11, S.B.L.P.; BE8, S.B.L.P.F.R.D.).
7) Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 1995 (or any order revoking and re-enacting that Order with or without modification), no alterations to the external appearance of the dwelling hereby permitted shall be carried out without the prior written approval of the District Planning Authority.
REASON: To control the external appearance of the dwelling in the interests of the amenities of the area.

8) Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 1995 (or any order revoking and re-enacting that Order with or without modification), no additional windows shall be inserted into the roof space of the proposed dwelling.
REASON: To protect the amenity of neighbouring residents.
(Policies BE11, S.B.L.P.; BE8, S.B.L.P.F.R.D.).
9) Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 1995 (or any order revoking and re-enacting that order), no excavation shall be carried out or surfacing constructed within the site, other than to form the proposed dwelling, access and driveway shown on the approved plan submitted on 5 December 2003, without the grant of further specific permission from the District Planning Authority.
REASON: To safeguard the future of the protected trees within and surrounding the site.
(Policies 8, 10, B.S.P.; BE11, NE6, S.B.L.P.; BE8, NE4, S.B.L.P.F.R.D.).
10) Prior to any work commencing on site, a root protection zone of 6m will be created around the trees within the site and 8m around the Cedar in the garden of number 5 The Pines. The root protection zone will be fenced in accordance with details agreed under condition 2 of this permission and the required distance will be measured from the trunk of the tree to the protective fencing. The fencing around the root protection zone will be retained until the completion of the development.
REASON: In order to safeguard the protected trees during construction as recommended in British Standard BS 5837 1991 "Trees in Relation to Construction".

11) The proposed access and driveway fronting the proposed dwelling will be constructed over the tree root system in accordance with Arboricultural Practice Note 1 "Driveways Close to Trees".
REASON: To safeguard the protected trees.
(Policies 8, 10, B.S.P.; BE11, NE6, S.B.L.P.; BE8, NE4, S.B.L.P.F.R.D.).
12) This permission relates only to the details shown on the Site Layout Plan received on 05/12/03 and Drawing Nos. 03-160/P/Rev C/1, 2, 3, and 03/160/E1/Rev C/3 and 03/160/E2/Rev C/4 received on 10/10/03 or to any subsequent appropriately endorsed revised plan.
REASON: To identify the approved plan/s and to avoid doubt.
