Conditions or Reasons for Planning Application - SB/04/00095
Conditions or Reasons:
1) The site lies within the South Bedfordshire Green Belt and the proposal would therefore conflict with Policy 24 of the Bedfordshire Structure Plan 2011, Policy GB1 of the South Bedfordshire Local Plan and Policy GB1 of the South Bedfordshire Local Plan First Review Deposit (and Proposed Modifications) whereby, within the Green Belt, permission will not be granted except in very special circumstances for development for purposes other than agriculture and forestry, mineral working, small scale facilities for outdoor sport and outdoor recreation or other uses appropriate to a rural area which preserve the openness of the Green Belt. No special circumstances have been established in this case.
2) Insofar as the proposal does not comprise the development of a small gap, as defined, in an otherwise built-up residential frontage the proposal would not comprise infilling as defined in Policy H13 of the South Bedfordshire Local Plan. To develop this site would further close up development on the periphery of the village and harm its rural character and, consequently, the character of the Chilterns Area of Outstanding Natural Beauty and Area of Great Landscape Value. Furthermore, the site is not within the village envelope of Kensworth as represented by the Green Belt and Infilling Boundary for Kensworth in the emerging South Bedfordshire Local Plan First Review Deposit (and Proposed Modifications) and the proposal would comprise inappropriate development in the Green Belt. The proposal is also contrary to Policy 35 of the Bedfordshire Structure Plan 2011 whereby in villages residential development will be limited to development within the village envelope and which respects the individual character of the village. It would consequently be contrary to Policies 6, 7, 24 and 35 of the Bedfordshire Structure Plan 2011, Policies NE2, NE3, BE11, GB1 and H13 of the South Bedfordshire Local Plan and Policies NE2, NE3, BE8, GB1 and GB2 of the South Bedfordshire Local Plan First Review Deposit (and Proposed Modifications).
3) To permit the proposed development on land which is located within the Green Belt and against a background of existing planning policies would establish a precedent whereby it would be difficult for the District Planning Authority to resist other similar proposals elsewhere in its area.
