Conditions or Reasons:
1) 1. The development shall begin not later than five years from the date of this permission. REASON: To comply with Section 91 of the Town and Country Planning Act 1990. 2. The existing trees and hedgerows as indicated on the plan in blue shall be retained and protected for the duration of the development in a manner to be approved in writing by the District Planning Authority and shall not be destroyed, uprooted, felled, lopped or topped during that period without the previous written consent of the District Planning Authority. Any trees or hedgerows removed without such consent or dying or being severely damaged or becoming seriously diseased during that period shall be replaced by trees or hedgerow specimens of such size and species as may be agreed with the District Planning Authority. Such trees or hedgerow specimens shall subsequently be maintained for a period of five years from the date of planting and any which die or are destroyed during this period shall be replaced during the next planting season and maintained until satisfactorily established. REASON: To comply with Section 197 of the Town and Country Planning Act 1990 and to safeguard existing trees on site. (Policies 8, 10, B.S.P.; BE11, H2, H6, T4, S.B.L.P.; BE8, H2, H6, T1, S.B.L.P.F.R.D.). 3. Before development begins, samples of the materials to be used for the external walls and roofs of all new buildings shall be submitted to and approved in writing by the District Planning Authority. REASON: To control the appearance of the building/s. (Policies 8, 10, B.S.P.; BE11, S.B.L.P.; BE8, S.B.L.P.F.R.D.). 4. Before development begins, the positions of the dwellings and garages shall be pegged out on site and their positions approved in writing by the District Planning Authority. REASON: To enable consideration to be given to the precise layout of the development. (Policies 8, 10, B.S.P.; BE11, H2, H6, S.B.L.P.; BE8, H2, H6, S.B.L.P.F.R.D.). 5. The garages shall be of the hipped roof design as shown on Drawing No. 6666/21 68. REASON: to minimise the impact upon neighbouring properties. (Policies 8, 10, B.S.P.; BE11, S.B.L.P.; BE8, S.B.L.P.F.R.D.). 6. Any garage or car port and any access thereto shall only be used for purposes incidental to the use of the dwelling for residential purposes and no trade or business shall be carried out therefrom. REASON: To prevent the introduction of any commercial use. (Policies 8, 10, B.S.P.; BE11, H2, T4, S.B.L.P.; BE8, H2, T1, S.B.L.P.F.R.D.). 7. Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 1995 (or any order revoking and re-enacting that Order), no extensions to the building/s hereby permitted shall be carried out without the grant of further specific permission from the District Planning Authority. REASON: To control the external appearance of the building/s in the interests of the amenities of the area. (Policies 8, 10, B.S.P.; BE11, H2, H6, S.B.L.P.; BE8, H2, H6, S.B.L.P.F.R.D.). 8. Before development begins, details of the proposed method of sewage disposal shall be submitted to and approved in writing by the District Planning Authority. The sewage disposal facilities as approved shall be constructed in accordance with the approved details before the development is first occupied or brought into use. REASON: To ensure satisfactory drainage of the site. (Policies 8, 10, 25, B.S.P.; BE11, H2, IS5, S.B.L.P.; BE8, H2, IS5, S.B.L.P.F.R.D.). 9. No soakaways shall be constructed in contaminated ground. REASON: To prevent pollution of groundwater. (Policies 8, 10, 25, B.S.P.; BE11, H2, H6, IS5, S.B.L.P.; BE8, H2, H6, IS5, S.B.L.P.F.R.D.). 10. Before the access is brought into use, a triangular vision splay shall be provided on each side of it measuring 2m along the fence, wall, hedge or other means of definition of the front boundary of the site, and 2m into the site at right angles to the same line along the side of the new access drive. The vision splays so provided and on land under the applicant's control shall be kept free of any obstruction to visibility exceeding a height of 600mm above the adjoining footway level. REASON: To provide adequate visibility between the existing highway and the proposed access(es) and to make the access(es) safe and convenient for the traffic which is likely to use it/them. (Policies 8, 20, 25, B.S.P.; BE11, T4, S.B.L.P.; BE8, T1, S.B.L.P.F.R.D.). 11. Before the development is first occupied or brought into use, the proposed vehicular access shall be surfaced in tarmacadam or other similar durable material as may be approved in writing by the District Planning Authority. Arrangements shall be made for surface water drainage from the site to be intercepted and disposed of separately so that it does not discharge into the highway. REASON: To avoid the carriage of mud or other extraneous material or surface water from the site into the highway so as to safeguard the interest of highway safety. (Policies 8, 10, 25, B.S.P.; BE11, H2, T4, S.B.L.P.; BE8, H2, T1, S.B.L.P.F.R.D.). 12. Before development begins, details of a wheel cleaning facility to be provided at all site exits shall be submitted to and approved in writing by the District Planning Authority. The facility shall be installed and made operational before development commences and retained until its substantial completion. It shall be removed from the site once the roadworks necessary to provide adequate access from the public highway have been completed (apart from final surfacing). REASON: To prevent the carriage of mud and other extraneous material onto the public highway in the interests of highway safety. (Policies 8, 10, 25, B.S.P.; BE11, H2, T4, S.B.L.P.; BE8, H2, T1, S.B.L.P.F.R.D.). 13. Before development commences, a survey of the wildlife population and their foraging areas within the site together with any necessary mitigation measures to be adopted before, during and after construction to minimise the effect of the development on the badger population shall be submitted to an approved in writing by the District Planning Authority. The approved mitigation measures shall be implemented in their entirety before any development begins and shall be retained in full during the course of the development and thereafter. REASON: To protect the badger population on or in the vicinity of the application site. (Policies 8, 10, B.S.P.; BE11, S.B.L.P.; BE8, S.B.L.P.F.R.D.). 14. Before development commences, details of a knee high fence to be erected between the application site and the footpath shall be submitted to and approved in writing by the District Planning Authority. REASON: To ensure that adequate privacy is maintained. (Policies 8, 10, B.S.P.; BE11, S.B.L.P.; BE8, S.B.L.P.F.R.D.). 15. This permission relates only to the details shown on Drawing No. 14360/1000, Drawing No. 6666/2168 received 08/03/00, Drawing No. 14360 1007 Rev A received 11/10/00 and Drawing No. 14360 1006 Rev C received 21/12/00 or to any subsequent appropriately endorsed revised plans. REASON: To identify the approved plans and to avoid doubt. INFORMATIVES ------------ 1. The adjacent public right of way must be accommodated in the development and at all times during development, the definitive line of this public right of way must remain unobstructed and open for use unless legal provision is made for a temporary closure of the route under Section 15 of the Road Traffic Act 1984. Any damage to the footpath by contractors vehicles is made good by the applicants. No materials shall be stored on the width of the footpath whilst development takes place. 2. As a result of the development, new highway street lighting will be required and the applicant must contact the Network Maintenance Group, Highways and Transport Division, Department of Environment and Economic Development, Bedfordshire County Council, County Hall, Bedford, MK42 9AP, for details of the works involved, the cost of which shall be borne by the developer. No development shall commence until the works have been approved in writing and the applicant has entered into a separate legal agreement covering this point with the Highway Authority. NOTE ---- In accordance with the Town and Country Planning (General Development Procedure) (England) (Amendment) Order 2000, the reason for any condition above relates to the Policies as referred to in the Bedfordshire Structure Plan 2011 (B.S.P.), South Bedfordshire Local Plan (S.B.L.P.) and South Bedfordshire Local Plan First Review Deposit (and Proposed Pre-Inquiry Changes) (S.B.L.P.F.R.D.)
