Conditions or Reasons for Planning Application - MB/00/00360/FULL
Conditions or Reasons:
1) 1. The development hereby approved shall be commenced within five years of the date of this permission.
2. The permission shall extend only to the application as amended by plans received on the 12th May 2000.
3. Details of the method of disposal of foul and surface water drainage shall be submitted to and agreed in writing by the Local Planning Authority including any land drainage system, before the development is commenced. Thereafter no part of the development shall be brought into use until the approved drainage scheme has been implemented.
4. Details of the materials to be used for the external walls and roof shall be submitted to and approved in writing by the Local Planning Authority prior to the commencement of the development hereby permitted.
5. Prior to commencement of the development hereby permitted development a detailed layout plan shall be submitted to and approved in writing by the Local Planning Authority showing the provision of 7 No. additional parking spaces within the curtilage of the Live and Let Live Public House. These spaces shall be provided prior to the first occupation of the Bed and Breakfast units and shall be retained at all times to the satisfaction of the Local Planning Authority.
6. Details of pile and beam or pad and beam foundations to be used for the development hereby permitted shall be submitted to and approved in writing by the Local Planning Authority prior to commencement of the development hereby permitted. These foundations shall be constructed in accordance with the approved details.
7. No development shall take place until full details of both hard and soft landscape works have been submitted to and approved in writing by the Local Planning Authority and these works shall be carried out as approved. These details shall include:- i) materials to be used for any hard surfacing; ii) proposed and existing functional services above and below ground level; iii) planting plans, including schedule of size, species, positions, density and times of planting; iv) cultivation details including operations required to establish new planting; v) details of existing trees and hedgerows on the site, indicating those to be retained and the method of their protection during development works.
8. The planting which shall have been approved consquent upon the submission of the scheme in accordance with Condition 7 above shall be carried out by a date which shall be not later than the end of the full planting season immediately following the completion of the development. Thereafter the planting shall be adequately maintained for a period of five years from the date of planting. Any of the trees or shrubs or both which die or are removed, or which become severely damaged or seriously diseased (during the said period of five years) shall be replaced with trees or shrubs or both, as the case may be, of similar size and species to those originally required to be planted and the same shall be maintained until properly established.
9. The windows in the rear facing elevation (elevation is on approved plan no. 1B) of the development hereby permitted shall be fitted with obscured glass of a type to substantially restrict vision through it at all times. No further windows or other openings shall be formed in the elevation. 10. The accommodation hereby approved shall only be used in association with the Live and Let Live Public House and shall not be operated or used as a separate or independent business or activity.

Reasons -------
1. To comply with Section 91 of the Town and Country Planning Act 1990 which is designed to ensure that a planning permission does not continue in existence indefinitely if the development to which it relates is not carried out.
2. For the avoidance of doubt and to ensure that the development is implemented in accordance with the plans formally approved by the Local Planning Authority.
3. To ensure that adequate foul and surface water drainage is provided and that existing and future land drainage needs are protected.
4. To protect the visual amenities of the building and of the area generally.
5. To enable vehicle to draw off the highway and park within the site in the interest of road safety.
6. To safeguard neighbouring trees and hedges.
7. In order to ensure that the landscaping is carried out within a reasonable period in the interest of the visual amenities of the area.
8. In order to ensure that the planting is carried out within a reasonable period in the interest of the visual amenities of the area.
9. To safeguard the amenities of occupiers of adjoining properties.
10. To ensure that the business from accommodation helps to support the public house to maintain its vitality and viability. Signed...................... Date of Decision 20th June 2000 Head of Planning Services
