Conditions or Reasons for Planning Application - MB/02/00029/FULL
Conditions or Reasons:
1) 1. The development hereby approved shall be commenced within five years of the date of this permission.

2. Details of the materials to be used for the external walls and roof shall be submitted to and approved in writing by the Local Planning Authority prior to the commencement of the development hereby permitted.

3. No development shall take place until full details of both hard and soft landscape works have been submitted to and approved in writing by the Local Planning Authority and these works shall be carried out as approved. These details shall include:-
i) means of enclosure;
ii) planting plans, including schedule of size, species, positions, density and times of planting; iii) details of existing trees and hedgerows on the site, indicating those to be retained and the method of their protection during development works.

4. The planting which shall have been approved consequent upon the submission of the scheme in accordance with Condition 2 above shall be carried out by a date which shall be no later than the end of the full planting season immediately following the first occupation of the building(s) hereby approved Thereafter the planting shall be adequately maintained for a period of five years from the date of planting. Any of the trees or shrubs or both which die or are removed, or which become severely damaged or seriously diseased (during the said period of five years) shall be replaced with trees or shrubs or both, as the case may be, of similar size and species to those originally required to be planted and the same shall be maintained until properly established.

5. Details of the method of disposal of foul and surface water drainage shall be submitted to and agreed in writing by the Local Planning Authority including any land drainage system, before the development is commenced. Thereafter no part of the development shall be brought into use until the approved drainage scheme has been implemented.

6. The permission shall extend only to the application as amended by letter and plans received on the 27/02/02 & 01/03/02.

7. This permission shall not be exercised in addition to or in combination as to part with existing Planning Permission Reference No. 44/00/213 dated 06/06/00 or 44/01/742 dated 03/12/01 but shall be treated as an alternative to the said permission.

8. The first floor window(s) in the south elevation of the dwelling on plot 11 shall be fitted with obscured glass of a type to substantially restrict vision through it at all times, and restriction on its opening, details of which shall be submitted to and agreed in writing by the Local Planning Authority prior to the development commencing on site.

1. To comply with Section 91 of the Town and Country Planning Act 1990 which is designed to ensure that a planning permission does not continue in existence indefinitely if the development to which it relates is not carried out.

2. To protect the visual amenities of the building and of the area generally.

3. In the interests of the visual amenities of the site and the area generally.

4. In order to ensure that the landscaping is carried out within a reasonable period in the interest of the visual amenities of the area.

5. To ensure that adequate foul and surface water drainage is provided and that existing and future land drainage needs are protected.

6. For the avoidance of doubt and to ensure that the development is implemented in accordance with the plans formally approved by the Local Planning Authority.

8. To safeguard the amenities of occupiers of adjoining properties.
