Conditions or Reasons for Planning Application - MB/02/00623/FULL
Conditions or Reasons:
1) The development hereby approved shall be commenced within five years of the date of this permission.

Reason: To comply with Section 91 of the Town and Country Planning Act 1990 which is designed to ensure that a planning permission does not continue in existence indefinitely if the development to which it relates is not carried out.
2) Details of the materials to be used for the external walls and roof for the proposed hide shall be submitted to and approved in writing by the Local Planning Authority prior to the commencement of the development hereby permitted. The hide shall be constructed in full accordance with the approved details.

Reason: To protect the visual amenities of the building and of the area generally.
3) The land shall be used as a wildlife habitat and no other purpose, including an extension to the existing residential garden/curtilage of the dwelling known as 101 East Road, Langford. If the wildlife habitat ceases to be used as such then the land shall be returned to agriculture within 2 months of the cessation of the use.

Reason: To ensure that the land is used for the specific use applied for and for no other use.
4) This permission shall not be exercised by any person other than Peter Williams and shall not enure for the benefit of the land.

Reason: The Local Planning Authority considers that the exceptional personal circumstances of the applicant override the planning objections which would normally compel the authority to refuse permission for the development hereby permitted.
5) No development shall take place until a full specification of the wildlife habitat has been submitted to and approved in writing by the Local Planning Authority. These details shall include:-

The timing for the implementation of the individual aspects relating to the habitat and details of the habitat's future maintenance

means of enclosure;

planting plans, including schedule of size, species, positions, density and times of planting;

The works shall be undertaken in accordance with the approved plans no later than the end of the full planting season following the commencement of the development.

Reason: In order to ensure that the landscaping is carried out within a reasonable period in the interest of the visual amenities of the area.
6) The proposed hide shall be used purely as a hide in connection with the wildlife habitat use. Should the use of the hide cease for its intended use/purpose, it shall be removed from the site within 2 months of the date of when its intended use ceases.

Reason: To protect the visual amenities of the area in general.
7) The bund hereby approved shall be constructed using only inert material.

Reason: To safeguard the risk of any pollution that may result from the construction of the bund and to protect the visual amenities of the area genrally.
