Conditions or Reasons for Planning Application - SB/05/00916/OUT
Conditions or Reasons:
1) The site lies within the South Bedfordshire Green Belt and the proposal would therefore conflict with Policy 24 of the Bedfordshire Structure Plan 2011 and Policy GB1 of the South Bedfordshire Local Plan Review whereby, within the Green Belt, permission will not be granted except in very special circumstances for development for purposes other than agriculture and forestry, mineral working, small scale facilities for outdoor sport and outdoor recreation or other uses appropriate to a rural area which preserve the openness of the Green Belt. No special circumstances have been established in this case.
2) The Office of the Deputy Prime Minister's Planning Policy Guidance Note 15: Planning and the Historic Environment states that applicants for planning permission within Conservation Areas must be able to justify their proposals. They should provide the local planning authority with full information, to enable them to assess the likely impact of their proposals on the special architectural or historic interest of the building and on its setting. Policy BE5 (Control of Development in Conservation Areas) of the South Bedfordshire Local Plan Review specifies that all proposals affecting Conservation Areas and their settings should be accompanied by sufficient detail and supporting information to enable the impact of the proposal on the character or appearance of the Conservation Area to be fully assessed. From the submitted details it is not possible to assess the likely impact of the proposals on the character and setting of the Conservation Area. The proposal is therefore contrary to Paragraph 3.4 of the Office of the Deputy Prime Minister's Planning Policy Guidance Note 15: Planning and the Historic Environment, Policy 13 of the Bedfordshire Structure Plan 2011 and Policies BE4 & BE5 of the South Bedfordshire Local Plan Review.
3) The proposal is contrary to Policy 24 of the Bedfordshire Structure Plan 2011, and to Policies GB1 and H12 of the South Bedfordshire Local Plan Review, whereby planning permission will not be granted for additional residential development in rural areas with the exception, in Category 2 villages, of infill sites which are physically contained by existing development and where infilling would not result in an adverse impact on the setting of the site and the character of the area. This proposal does not constitute infilling and Totternhoe is not designated as a Category 2 village in the South Bedfordshire Local Plan Review.
4) The proposed development would, by reason of the location of the site, accessed through a farmyard from the rear of an enclosed garage court with no street frontage, fail to reflect and respect the character and appearance of other residential development in the vicinity, and would detract from the amenity of the surrounding area and result in an unacceptable level of residential amenity for prospective occupiers in terms of outlook and minimising the opportunities for crime. The proposal is therefore contrary to Policy 10 of the Bedfordshire Structure Plan 2011 and Policies H2, H12 and BE8 of the South Bedfordshire Local Plan Review.
5) The intensification of use of the access way in close proximity to number 1 Church Green would be likely to have an adverse impact on the residential amenity of the occupiers of that adjacent property by reason of noise, nuisance and disturbance. The proposal is therefore contrary to Policy 10 of the Bedfordshire Structure Plan 2011 and Policy BE8 of the South Bedfordshire Local Plan Review.
6) To permit the proposed development on land which is located within the Green Belt and against a background of existing planning policies would establish a precedent whereby it would be difficult for the District Planning Authority to resist other similar proposals elsewhere in its area.
