Conditions or Reasons for Planning Application - MB/03/00795/FULL
Conditions or Reasons:
1) The development hereby approved shall be commenced within five years of the date of this permission.

Reason: To comply with Section 91 of the Town and Country Planning Act 1990 which is designed to ensure that a planning permission does not continue in existence indefinitely if the development to which it relates is not carried out.
2) Details of the external colouration of the storage containers hereby approved shall be submitted to and approved in writing by the Local Planning Authority.

Reason: To safeguard the appearance of the completed development by ensuring that the development hereby permitted is finished externally with materials to minimise its visual impact in the wider landscape.
3) The scheme of pollution control previously approved under condition 5 attached to planning permission Ref No 02/00378/FULL dated 9 September 2002 shall remain in operation unless otherwise agreed in writing by the Local Planning Authority.

Reason: To prevent the incresed risk of pollution to the water environment.
4) All HGVs visiting the site in connection with the development proposed shall not use Newton to access the site. Vehicular access shall be taken from Sutton Road.

Reason: In order to protect the amenities of local residents.
5) All refrigerated units parked on the site between 2000 and 0700 hours shall be sited on the new hardstanding the subject of this approval and located approximately 26 metres to the west of the existing haulage building .

Reason: In order to protect the amenities of nearby residents.
6) No part of the land to the west of the line marked A-B on plan no. 10839/7/A shall be used for the parking, or repairing of HGVs or any purpose in association with the haulage use other than in respect of the turning of vehicles.

Reason: In order to protect the amenities of nearby dwellings.
7) The new yard area the subject of this approval shall only be used for the parking of vehicles.

Reason: In order to protect the character of the area.
12) No equipment, goods, waste or other materials shall be deposited or stored in the open outside the buildings on the site.

Reason: To safeguard the character and appearance of the site and the surrounding area.
13) Details of any floodlighting shall be submitted to and approved in writing by the Local Planning Authority before
any of the building(s) is/are brought into use
the use hereby permitted commences
that part of the site is brought into use.

Reason: To protect the visual amenities of the site and its surrounding area.
14) The containers hereby approved shall be used solely for the storage of items ancillary to the current haulage use on the site and for no other purpose and by no other user without the prior written approval of the Local Planning Authority.

Reason: To prevent the formation of a separate planning unit in the interests of the amenities of adjacent occupiers, highway safety and the visual amenities of the area.
15) Notwithstanding the works timetable details submitted in support of planning permission Ref No 02/00378/FULL, a revised detailed timetable of works shall be submitted to and approved in writing by the Local Planning Authority within 28 days of the date of this permission. Works shall be undertaken in strict accordance with the approved schedule.

Reason: In order to protect the amenities of nearby dwellings.
