Conditions or Reasons for Planning Application - SB/06/00010
Conditions or Reasons:
1) The development shall begin not later than three years from the date of this permission.
REASON: To comply with Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2) The planting and landscaping scheme shown on approved Drawing No. 179/2005-03 Rev.A shall be implemented by the end of the full planting season immediately following the completion and/or first use of any separate part of the development (a full planting season shall mean the period from October to March). The trees, shrubs and grass shall subsequently be maintained for a period of five years from the date of planting and any which die or are destroyed during this period shall be replaced during the next planting season and maintained until satisfactorily established.
REASON: To ensure a satisfactory standard of landscaping.

3) Before the development is first occupied or brought into use, the parking scheme shown on Drawing No. 179/2005-03 Rev.A shall be completed and thereafter retained for this purpose.
REASON: To ensure provision for car parking clear of the highway.
(Policies 42, B.S.P.; T10, S.B.L.P.R).
4) The premises shall only be used for a residential care home and for no other purpose in Class C2 of the Schedule to the Town and Country Planning (Use Classes) Order 1987 (as amended) (or any order revoking and re-enacting that Order with or without modification).
REASON: To control the development in the interests of amenity.
(Policy BE8, S.B.L.P.R).
5) The access shall have a minimum width of 4.1 metres, and shall be located 1.8 metres from the south-eastern boundary of the application site.
REASON: In the interest of road safety and for the avoidance of doubt.
(Policies 42, B.S.P.; T1, S.B.L.P.R).
6) Before the development is brought into use, signs notifying users of the access of the presents of a school crossing patrol site shall be provided at the means of egress in accordance with a scheme to be submitted to and approved by the District Planning Authority.
REASON: In the interest of road safety and traffic movement
(Policies 42, B.S.P.; T1, S.B.L.P.R).
7) Before the access is first brought into use a triangular vision splay shall be provided on each side of the new access and shall measure 1.8 metres along the fence, wall, hedge or other means of definition of the front boundary of the site, and 1.8 metres measured into the site at right angles to the same line along the side of the new access drive. The vision splays so described and on land under the applicants control shall be maintained free of any obstruction to visibility exceeding a height of 600mm above the adjoining footway level.
REASON: To provide adequate visibility between the existing highway and the proposed access, and to make the access safe and convenient for the traffic which is likely to use it.

8) Before the access is brought into use an area of land across the whole of the site frontage measuring at least 1.8 metres from and parallel to the nearside edge of the adjacent road carriageway shall be provided and thereafter be kept free of all obstruction to visibility over a height of 1.05 metres above the adjoining road channel level.
REASON: To provide adequate visibility between the existing highway and the proposed access, and to make the access safe and convenient for the traffic which is likely to use it.

9) Before the access is brought into use all works associated with the alterations of the School Crossing Patrol Site in accordance with details of the approved drawing/or scheme to be submitted to and approved by the District Planning Authority. Any Statutory Undertakers equipment or street furniture shall be resited to provide this unobstructed crossing point.
REASON: In the interests of road safety and pedestrian movement.

10) The maximum gradient of the vehicular access shall be 10% (1 in 10).
REASON: In the interests of the safety of persons using the access and users of the highway.
(Policies 42, B.S.P.; T1, S.B.L.P.R).
11) Before the premises are occupied all on site vehicular areas shall be surfaced in a manner to the District Planning Authoritys approval so as to ensure satisfactory parking of vehicles outside highway limits. Arrangements shall be made for surface water from the site to be intercepted and disposed of separately so that it does not discharge into the highway.
REASON: In order to minimise danger, obstruction, and inconvenience to users of the highway and of the premises.

12) This permission relates only to the details shown on the Site Location Plan received 05/01/06 and Drawing Nos. 179/2005-02 Rev.D, 179/2005-03 Rev.A & 179/2005-04 received 01/03/06 or to any subsequent appropriately endorsed revised plan.
REASON: To identify the approved plan/s and to avoid doubt.
