Conditions or Reasons for Planning Application - MB/04/01725/FULL
Conditions or Reasons:
1) The development hereby approved shall be commenced within five years of the date of this permission.

Reason: To comply with Section 91 of the Town and Country Planning Act 1990 which is designed to ensure that a planning permission does not continue in existence indefinitely if the development to which it relates is not carried out.
2) Details of materials to be used for the external finishes of the development hereby approved shall be submitted to and approved in writing by the Local Planning Authority.

Reason: To safeguard the appearance of the completed development by ensuring that the development hereby permitted is finished externally with materials to match/complement the existing building(s) and the visual amenities of the locality.
3) Equipment shall be installed on site to suppress and disperse fumes and/or odours produced by cooking and food preparation, and the equipment shall be effectively operated for so long as the permitted use continues. Details of the equipment, including technical information and elevation plans, shall be submitted to and approved in writing by the Local Planning Authority and the equipment shall be installed and in full working order and in accordance with the approved plans prior to commencement of the use hereby permitted.

Reason: To safeguard the amenities which the occupiers of neighbouring residential properties might reasonably expect to enjoy.
4) The use hereby approved shall not operate except between the hours of 08.30 to 23.00 on any day of the week.

Reason: To safeguard the amenities which the occupiers of neighbouring residential properties might reasonably expect to enjoy.
5) All plant, machinery and equipment (including fans, ducting and external openings) to be used by reason of the granting of this permission shall be so installed, maintained and operated so as to prevent the transmission of noise and vibration into any premises either attached to, or in the vicinity of the building the subject of this planning permission.

Reason: To safeguard the amenities which occupiers of neighbouring residential properties might reasonably expect to enjoy.
6) The extraction equipment installed in pursuance to Condition 3 above shall be regularly maintained to ensure its continued satisfactory operation and the cooking process shall cease to be operated if at any time the extraction equipment ceases to function to the satisfaction of the Local Planning Authority.

Reason: To safeguard the amenities which the occupiers of neighbouring residential properties might reasonably expect to enjoy.
7) The permission hereby granted shall not be exercised in addition to or in combination as to part with Planning Permission Reference: 12/MB/95/1410 dated 16/04/1996, Number 191 High Street, Cranfield, but shall be treated as an alternative to the said permission.

Reason: To ensure that only one approved scheme is implemented in the interests of the amenities of occupiers of neighbouring residential properties.
