Conditions or Reasons for Planning Application - MB/05/00198/FULL

Conditions or Reasons:

1) Within two months from the date of this permission, the proposed vehicular access shall be surfaced in bituminous or other similar durable material as may be approved in writing by the Local Planning Authority for a distance of 4.0m into the site, measured from the highway boundary. Arrangements shall be made for surface water drainage from the site to be intercepted and disposed of separately so that it does not discharge into the highway.

Reason: To avoid the carriage of mud or other extraneous material or surface water from the site into the highway so as to safeguard the interest of highway safety.

2) Within two months from the date of this permission, visibility splays shall be provided at the junction of the access with the public highway. The minimum dimensions to provide the required splay lines shall be 2.0m measured along the centre line of the proposed access from its junction with the channel of the public highway and 20.0m measured from the centre line of the proposed access along the line of the channel of the public highway towards the east-southwards direction. The required vision splays shall, on land in the applicant's control, be kept free of any obstruction.

Reason: To provide adequate visibility between the existing highway and the proposed access, and to make the access safe and convenient for the traffic which is likely to use it.

3) The access and parking area hereby approved shall only be used by employees of The Black Horse and at no time be for the use of customers.

Reason: In the interests of highway safety.

4) Within two months of the date of this approval, details of a replacement hedge to be planted behind the new visibility splay shall be submitted to and approved by the Local Planning Authority. The hedge shall be planted in the next planting season following the approval of the said details and maintained thereafter in a satisfactory condition. Any hedge plants shall be replaced if they die within 5 years.

Reason: In order to protect the character of the area.
