Conditions or Reasons for Planning Application - MB/06/00219/FULL
Conditions or Reasons:
1) The development hereby approved shall be commenced within three years of the date of this permission.

Reason: To comply with Section 91 of the Town and Country Planning Act 1990 which is designed to ensure that a planning permission does not continue in existence indefinitely if the development to which it relates is not carried out.
2) No development shall take place until full details of both hard and soft landscape works have been submitted to and approved in writing by the Local Planning Authority and these works shall be carried out as approved. These details shall include:-

i) proposed boundary screen planting on the north, west and east boundaries to mitigate visual impact
ii) proposed finished levels or contours;
iii) materials to be used for any hard surfacing;
iv) proposed and existing functional services above and below ground level;
v) planting plans, including schedule of size, species, positions, density and times of planting;
vi) cultivation details including operations required to establish new planting;

Reason: In order to ensure that the landscaping is carried out within a reasonable period in the interest of the visual amenities of the area.
2) Discharge of condition no. 2 (iv) re: Proposed and existing functional services above and below ground level.
3) All hard and soft landscape works shall be carried out in accordance with the approved details. The works shall be carried out prior to the occupation of any part of the development or in accordance with a programme agreed in writing with the Local Planning Authority.

Reason: In order to ensure that the planting is carried out within a reasonable period in the interest of the visual amenities of the area.
4) No development shall take place until there has been submitted to and approved in writing by the Local Planning Authority a plan indicating the positions, design, materials and type of boundary treatment to be erected. The boundary treatment shall be completed before the dwellings are first occupied. Development shall be carried out in accordance with the approved details.

Reason: To safeguard the appearance of the completed development, the visual amenities of the locality and the privacy of adjoining occupier(s).
5) Notwithstanding the provisions of conditions 2 and 4 above, a fence of a height, design and in materials to be first submitted to and approved in writing by the Local Planning Authority shall be erected prior to the first occupation of the development on the southern boundary of the garden of Unit B.

Reason: To safeguard the amenity and privacy of occupiers of the existing adjoining dwelling and in the interests of visual amenity.
6) Notwithstanding any provision of the Town and Country Planning (General Permitted Development) Order 1995 (or any Order revoking or re-enacting that Order with or without modification) no further window, door or other openings shall be formed in the north, south, east or west exterior elevations or roof planes of the buildings (excluding the internal courtyard facing walls) without without the prior written permission of the Local Planning Authority to an application for planning permission on that behalf.

Reason: To protect the amenities of occupiers of neighbouring properties.
7) Details of the means of internal noise insulation between the dwellings the subject of this permission, to ensure that noise emanating from them does not cause nuisance to neighbouring occupiers, shall be submitted and approved in writing by the Local Planning Authority before any work is commenced on the site. Development shall be carried out in accordance with the details so approved.

Reason: To ensure that the amenities of adjoining occupiers are not prejudiced by excessive noise.
8) Details of the materials to be used for the external walls and roof shall be submitted to and approved in writing by the Local Planning Authority prior to the commencement of the development hereby permitted.

Reason: To protect the visual amenities of the building and of the area generally.
9) Details of the materials and colouration to be used for the rainwater goods to the development hereby permitted shall be submitted to and approved in writing by the Local Planning Authority prior to the commencement of development. The works shall be completed in accordance with the approved details.

Reason: To safeguard the special architectural and historic interest of this statutorily listed building in accordance with Policy BE6 of the Mid Bedfordshire Local Plan.
10) Before the development hereby permitted is first commenced details of all on site vehicular areas, including access ways, parking areas and turning areas shall be first submitted to an approved in writing by the Local Planning Authority. The access ways, parking areas and turning areas so approved shall be laid out and surfaced in accordance with the details so approved. Arrangements shall be made for surface water from the site to be intercepted and disposed of separately so that it does not discharge into the highway.

Reason: In order to minimise danger, obstruction, and inconvenience to users of the highway and of the premises.
11) Prior to the commencement of development a survey of the site shall be undertaken to ascertain as to whether there are any bats roosting on the site and whether barn owls roost on the site. If any of the above species are found to exist the details of measures to be undertaken to safeguard these protected species then habitat protection measures shall be submitted to and approved in writing by the Local Planning Authority. The habitat protection measures shall be implemented to the satisfaction of the Local Planning Authority and in accordance with a timetable agreed in writing by the Local Planning Authority.

Reason: To enable proper consideration of the impact of the development on the contribution of nature conservation interests to the amenity of the area.
12) No part of the existing building(s) shall be demolished other than the part(s) clearly shown on the submitted plans hereby approved.

Reason: To ensure that as much as possible of the existing building(s) is(are) maintained to protect the character and amenities of the area.
13) Prior to the commencement of the conversion of the barns a method of work statement indicating the sequence of works shall be submitted to and approved in writing by the Local Planning Authority and thereafter adhered to during construction works.

Reason: To maintain the integrity and character of the building.
14) No works shall commence on the alterations and conversion works hereby approved until details showing the sequence of alteration works and the measures to provide adequate support or restraint to walls and floors of the building (the structural stability of which may be prejudiced by the works hereby approved) have been submitted to and approved in writing by the Local Planning Authority.

Reason: To ensure that the structural stability of the building is maintained.
15) Prior to the commencement of development details of the proposed treatment and/or decoration for the external wall surfaces shall be submitted to and approved in writing by the Local Planning Authority. The works shall be carried out and completed strictly in accordance with the approved details.

Reason: To maintain the integrity and character of the building and to secure a satisfactory visual appearance.
16) Before the development hereby permitted is first commenced, details of the provision of on site facilities for refuse/bin storage for each unit shall be first submitted to and approved in writing by the Local Planning Authority. Development shall be carried out in accordance with the approved details.

Reason: To ensure satisfactory and adequate provision for refuse disposal.
17) Notwithstanding any provision of the Town and Country Planning (General Permitted Development Order) 1995 (or any Order revoking or re-enacting that Order with or without modification) no works shall be commenced for extensions, the erection of buildings or alterations falling within Classes A, B, C, D and E of Part 1 of Schedule 2 of the Order without the prior written permission of the Local Planning Authority upon an application for planning permission in that behalf.

Reason: To protect the amenities of occupiers of the development and those of the occupiers of the existing neighbouring property. Also to preserve the character and appearance of the barns to be converted.
