Conditions or Reasons for Planning Application - MB/06/00802/FULL
Conditions or Reasons:
1) The development hereby approved shall be commenced within three years of the date of this permission.

Reason: To comply with Section 91 of the Town and Country Planning Act 1990 which is designed to ensure that a planning permission does not continue in existence indefinitely if the development to which it relates is not carried out.
2) Prior to the commencement of any development, a scheme for the provision and implementation of foul water drainage shall be submitted to and agreed in writing with the Local Authority. The works/scheme shall be constructed and completed in accordance with the approved plans/specification at such time(s) as may be specified in the approved scheme.

Reason: To prevent the increased risk of pollution to the water environment.
3) The premises shall not be used except between 0900 hours and 1830 hours Monday - Friday, 1000 hours to 1200 hours on Saturdays and at no time on Sundays, Bank or Public Holidays, without the prior agreement in writing of the Local Planning Authority.

Reason: To safeguard the amenities of occupiers of nearby properties.
4) The use hereby permitted shall not commence until provision has been made within the site for the storage and disposal of all litter and waste resulting from the permitted use, and such provision shall be in accordance with details agreed in writing with the Local Planning Authority.

Reason: In the interests of neighbouring amenity and to prevent pollution of the environment.
5) No commercial waste arising from the permitted use shall be burnt on site.

Reason: To safeguard the amenities of occupiers of nearby properties.
6) The land use and buildings hereby permitted shall be exclusively for the boarding of cats only.

Reason: To prevent the premises being used for a non appropriate similar commercial use.
7) This permission shall not be exercised by any person other than Mr M J and Mrs L Lumley and shall not enure for the benefit of the land.

Reason: The Local Planning Authority considers that the personal circumstances of the applicant override the planning objections which would normally compel the authority to refuse permission for the development hereby permitted.
8) The number of cat pens/chalets on the site shall not exceed 5 in total and no more than 12 cats can be boarded at any one time. No further cat pens/chalets shall be provided without the written approval of the Local Planning Authority.

Reason: To enable the Local Planning Authority to control the future development of the site, in the interests of residential amenity and highway safety.
9) Only neutered (male and female) cats shall be boarded at the premises.

Reason: To reduce the impact of noise and smell and to safeguard the amenities of occupiers of nearby properties.
10) In the event that the cattery business ceases trading, the buildings and works hereby permitted shall be removed within three months of the cessation of use and the site reinstated to its previous condition or to such a condition as may be beforehand agreed in writing by the Local Planning Authority.

Reason: To ensure that the site is reinstated to a satisfactory condition if the buildings are no longer required.
