Conditions or Reasons for Planning Application - MB/06/01531/FULL
Conditions or Reasons:
1) The development hereby approved shall be commenced within three years of the date of this permission.

Reason: To comply with Section 91 of the Town and Country Planning Act 1990 which is designed to ensure that a planning permission does not continue in existence indefinitely if the development to which it relates is not carried out.
2) Samples of the materials to be used for the external walls and roof shall be submitted to and approved in writing by the Local Planning Authority prior to the commencement of the development hereby permitted.

Reason: To ensure a satisfactory visual appearance and to protect the Conservation Area and the setting of the nearby Listed Building.
3) Details of the materials and colouration to be used for the rainwater goods to the development hereby permitted shall be submitted to and approved in writing by the Local Planning Authority prior to the commencement of development. The works shall be completed in accordance with the approved details.

Reason: To ensure a satisfactory visual appearance and to protect the Conservation Area and the setting of the nearby Listed Building.
4) The new windows and doors shall be of timber and single glazed unless otherwise agreed and approved in writing by the Local Planning Authority.

Reason: To safeguard the special architectural and historic interest of this statutorily Listed Building in accordance with Policy CHE1 of the Mid Bedfordshire Local Plan First Review 2005.
5) The external finish for all windows and doors shall be submitted to and approved in writing by the Local Planning Authority prior to the commencement of the development hereby approved.

Reason: To safeguard the special architectural and historic interest of this statutorily Listed Building in accordance with Policy CHE1 of the Mid Bedfordshire Local Plan First Review 2000.
6) A 1:1 scale drawing or a sample of the glazing bars for the window shall be submitted to and approved in writing by the Local Planning Authority prior to the commencement of the development hereby approved.

Reason: To safeguard the special architectural and historic interest of this statutorily Listed Building in accordance with Policy CHE1 of the Mid Bedfordshire Local Plan First Review 2005.
7) A sample panel indicating brick type, bond and mortar mix shall be inspected and approved in writing by the Local Planning Authority prior to the commencement of works hereby approved. Development shall be implemented in full accordance with the approved details.

Reason: To safeguard the special architectural and historic interest of this statutorily Listed Building in accordance with Policy CHE1 of the Mid Bedfordshire Local Plan First Review 2005.
8) Details of the coping stones to be used for the parapet shall be submitted to and approved in writing by the Local Planning Authority prior to commencement of the development.

Reason: To safeguard the special architectural and historic interest of this statutorily Listed Building in accordance with Policy CHE1 of the Mid Bedfordshire Local Plan First Review 2005.
9) Replacement planting in accordance with approved details shall take place as soon as practicable and in any event within six months of the felling being carried out. The replacement planting shall be maintained for a period of three years beginning with the date of the felling operation and during this period any trees that die or become diseased shall be replaced with trees of the same size and species.

Reason: In order to ensure that the planting is carried out within a reasonable period in the interest of the visual amenities of the area.
10) The access and driveway shall be constructed using a 'no-dig' method of construction as outlined in Arboricultural Practice Note no.1 (Driveways close to trees).

Reason: To ensure the protection of trees and hedgerows to be retained, and in particular to avoid unnecessary damage to their root systems.
11) Before the access is first brought into use a triangular vision splay shall be provided on each side of the new access and shall measure 1.8m along the fence, wall, hedge or other means of definition of the front boundary of the site and 1.8m measured into the site at right angles to the same line along the side of the new access drive. The vision splays so described and on land under the applicant's control shall be maintained free of any obstruction to visibility exceeding a height of 600mm above the adjoining footway level.

Reason: To provide adequate visibility between the existing highway and the proposed access, and to make the access safe and convenient for the traffic which is likely to use it.
12) The proposed vehicular access shall be surfaced in bituminous or other similar durable material as may be approved in writing by the Local Planning Authority before the access if first brought into use. Arrangements shall be made for surface water drainage from the site to be intercepted and disposed of separately so that it does not discharge into the highway.

Reason: To avoid the carriage of mud or other extraneous material or surface water from the site into the highway so as to safeguard the interest of highway safety.
13) Any gates provided shall open away from the highway and be set back a distance of at least 5.0m from the nearside edge of the carriageway of the adjoining highway.

Reason: To enable vehicles to draw off the highway before the gates are opened.
14) The maximum gradient of the vehicular access shall be 10% (1 in 10).

Reason: In the interests of the safety of persons using the access and users of the highway.
15) The new vehicular access shall enter the public highway at the boundary at such a level as shall be agreed in writing by the Local Planning Authority. Any necessary gradient shall be constructed on the application site entirely outside highway limits.

Reason: To secure a satisfactory access appropriate to the development, in the interest of public safety and convenience.
16) Before the new access is brought into use all new on site vehicular areas shall be surfaced in a manner to the Local Planning Authority's approval so as to ensure satisfactory parking of vehicles outside highway limits. Arrangements shall be made for surface water from the site to be intercepted and disposed of separately so that it does not discharge into the highway.

Reason: In order to minimise danger, obstruction and inconvenience to users of the highway and of the premises.
