Conditions or Reasons for Planning Application - MB/07/00281/FULL
Conditions or Reasons:
1) Notwithstanding the provisions of the Town and Country Planning (General Permitted Development Order) 1995, (or any Order revoking or re-enacting that Order with or without modification) no works shall be commenced for the extension or material alteration of the building of plot 53 or the erection of any building or structure within its curtilage, until detailed plans and elevations have been submitted to and approved in writing by the Local Planning Authority.

Reason: In order to protect the streetscene in this visually prominent location.
2) Notwithstanding any provision of the Town and Country Planning (General Permitted Development) Order 1995 (or any Order revoking or re-enacting that Order with or without modification) no further window or other opening shall be formed on the west facing elevation of plot 53.

Reason: To protect the amenities of occupiers of neighbouring properties.
3) The conservatory of plot 53 hereby approved shall be constructed of timber unless otherwise agreed in writing by the Local Planning Authority.

Reason: The design of key buildings must reflect their importance and can be achieved by careful attention to detail and materials. In accordance with the Urban Design Strategy for Fairfield Park.
4) All windows in plot 53 hereby approved shall be timber, sliding sash windows unless otherwise agreed in writing by the Local Planning Authority. The timber sliding sash windows shall be retained as such thereafter.

Reason: For the avoidance of doubt.
5) Notwithstanding the provisions of the Town and Country Planning General Permitted Development Order 1995, or any amendments thereto, the garage accommodation on the site shall not be used for any purpose, other than as garage accommodation, unless permission has been granted by the Local Planning Authority on an application made for that purpose.

Reason: To retain off-street parking provision and thereby minimise the potential for on-street parking which could adversely affect the convenience of road users.
6) Decorative eaves detailing to plot 53 shall be implemented in accordance with details approved under condition no.11 of planning permission ref. 05/01045/RM unless otherwise agreed by the Local Planning Authority.

Reason: To ensure an appropriate form of development.
7) The development shall accord with the materials masterplan approved under planning permission 05/01045/RM unless otherwise agreed by the Local Planning Authority.

Reason: In order for the Local Planning Authority to assess this area of the development as a whole and to ensure the development is in accordance with the Adopted Urban Design Strategy for Fairfield Park.
8) The development hereby approved shall be completed in strict accordance with the details set out in the sustainability strategy approved pursuant to Schedule 1 Clause 16.1 of the Deed made pursuant to Section 106 of the Town and Country Planning Act 1990 relating to outline planning permission ref no 00/01151/OUT dated 7 February 2002.

Reason: In order to achieve a sustainable form of completed development in accordance with the requirements of PPG22.
9) The development shall be implemented in accordance with the details approved under condition no. 28 of planning permission ref. 05/01045/RM unless otherwise agreed by the Local Planning Authority.

Reason: To ensure that a satisfactory relationship results between the new development and adjacent buildings and public areas.
