Conditions or Reasons for Planning Application - MB/07/00592/FULL
Conditions or Reasons:
1) The proposal constitutes an unacceptable sub-division on an existing
residential curtilage and by nature of the siting, design and cramped visual
appearance would have an adverse impact on the character and appearance
of the street scene; as such the proposal is contrary to Policy DPS5 of the Mid
Bedfordshire Local Plan 2005.
2) The proposed development, by reason of its siting and juxtaposition with no. 9
Foresters Close, would appear visually obtrusive and harmful to the outlook
and residential amenities enjoyed by the occupiers of that property; as such
the proposal would be contrary to Policy DPS5 and DPS9 of the Mid
Bedfordshire Local Plan 2005.
3) The proposal, by virtue of the siting, design and relationship of the dwelling with the rear boundary would result in an unacceptable degree of overlooking and loss of privacy, to the overall detriment of the amenities currently enjoyed by the adjoining occupiers at nos. 9 and 11 Foresters Close. Furthermore the rear private amenity area of the proposed dwelling would itself be unacceptably overlooked. As such the proposal is contrary to Policies DPS5 and DPS9 of the Mid Bedfordshire Local Plan 2005.
4) The proposed development, would provide inadequate private amenity space
for the new dwelling and will result in inadequate area of garden being
retained for no. 9 Foresters Close; as such the proposal is contrary to Policy
DPS5 of the Mid Bedfordshire Local Plan 2005.
5) The application fails to demonstrate that adequate access and provision can
be made within the site for the parking of vehicles clear of the public highway
without detriment to the safety and convenience of users of the highway; as
such the proposal is contrary to Policy DPS5 of the Mid Bedfordshire Local
Plan 2005
