Conditions or Reasons for Planning Application - SB/06/00866
Conditions or Reasons:
1) The site is the subject of both a designation under Policy H1 of the South Bedfordshire Local Plan Review and the Southern Leighton Buzzard Development Brief. Insufficient and inadequate information has been submitted with the applications to enable the District Planning Authority to conclude that the development would be satisfactory with regards to its environmental impact, its design and its delivery of community infrastructure. The applications are lacking with regard to;
sufficiently detailed parameter plans
a clear programme of phasing and delivery for open space and community infrastructure, including a new lower school and a neighbourhood centre
a design assessment addressing the constraint of retaining the pylons on site
The delivery of the development is further unreasonably based on assumed amendments yet to be agreed to change the phasing of an existing quarry restoration permission currently being implemented.
In these circumstances it is considered that the submission of the applications are premature, and lack certainty as to the delivery of the necessary community infrastructure and quality of design. The proposals conflict with the design advice given in Planning Policy Statement 1, the requirements of the Southern Leighton Buzzard Development Brief, Policy 10 of the Bedfordshire County Structure Plan 2011 and Policies H1 and BE8 of the South Bedfordshire Local Plan Review.
2) The proposed spine road fails to meet the minimum design standard laid down in TD9/93 and would lead to a danger for all highway users. The proposal is therefore contrary to Policies T1 and T12 of the South Bedfordshire Local Plan Review.
3) The proposed development fails to make adequate provision for safe and convenient facilities for vulnerable highway users and fails to adequately promote sustainable modes of transport. Furthermore, inadequate information has been submitted with the Traffic Assessment. The proposal therefore conflicts with Policy 42 of the Bedfordshire Structure Plan 2011 and Policies T1 and T12 of the South Bedfordshire Local Plan Review.
4) There is insufficient information presently available to the Secretary of State to determine whether the proposed development would generate traffic on the trunk road (A5) to an extent that would be incompatible with the use of the trunk road as part of the national system of routes for through traffic in accordance with Section 10(2) of the Highways Act 1980, and with safety of traffic on the trunk road. In the light of this lack of information, the proposal would thereby be likely to give rise to conditions prejudicial to the free and safe flow of traffic on the A5 trunk road.
