Conditions or Reasons for Planning Application - MB/08/01863/FULL
Conditions or Reasons:
1) The development hereby approved shall be commenced within three years of the date of this permission.

Reason: To comply with Section 91 of the Town and Country Planning Act 1990 which is designed to ensure that a planning permission does not continue in existence indefinitely if the development to which it relates is not carried out.
2) Within one month of the date of this permission, the applicant shall submit in writing details of the arrangements for the storage and disposal of all commercial waste arising from the business hereby permitted, for the approval of the Local Planning Authority. All commercial waste arising shall be stored and disposed off in accordance with the approved details.

Reason :To ensure all commercial waste is properly disposed of and protect the amenity of neighbouring residential occupiers.
3) Before the access is first brought into use a triangular vision splay shall be provided on the west side of the access and shall measure 1.8m along the fence, wall, hedge or other means of definition of the front boundary of the site, and 1.8m measured into the site at right angles to the same line along the side of the access drive. The vision splays so described and on land under the applicant's control shall be maintained free of any obstruction to visibility exceeding a height of 600mm above the adjoining footway level.

Reason: To provide adequate visibility between the existing highway and the access, and to make the access safe and convenient for the traffic which is likely to use it.
4) Details of a bin collection point located outside of the highway and clear of any visibility splays shall be submitted to and approved by the Local Planning Authority prior to the use of the garage for commercial purposes.

Reason: In the interest of highway amenity.
5) Before development begins, a scheme for the parking of cycles on the site shall be submitted to and approved in writing by the Local Planning Authority. The scheme shall be fully implemented before the development is first occupied or brought into use and thereafter retained for this purpose.

Reason: To ensure the provision of adequate cycle parking to meet the needs of employees of the proposed development in the interests of encouraging the use of sustainable modes of transport.
6) Commercial deliveries of bread made between 0630 hours and 0700 hours Monday to Friday may only be received through the side door of the garage. Alternatively deliveries of bread may be received between the hours of 0700 and 1700 hours Monday to Friday, and at no time on Saturdays, Sundays, Bank or Public Holidays, without the prior agreement in writing of the Local Planning Authority.

Reason : To protect the amenity of neighbouring residential occupiers.
7) Deliveries of goods inwards (other than bread) by commercial vehicles to and from the site shall only be made once a week between 0900 hours and 1700 hours Monday to Friday, and at no time on Saturdays, Sundays, Bank or Public Holidays, without the prior agreement in writing of the Local Planning Authority.

Reason : To protect the amenity of neighbouring residential occupiers.
8) The operation of the business use allowed at 7 Elm Road will be limited to the hours of 0630 hours to 1700 hours on Monday to Friday, and at no time on Saturdays, Sundays, Bank or Public Holidays, without the prior agreement in writing of the Local Planning Authority. Non resident staff shall not arrive at the site before 0700 hours.

Reason : To protect the amenity of neighbouring residential occupiers.
9) The mixed use permission hereby permitted shall extend only to the use of the building as a domestic garage and business use for the preparation and distribution of sandwiches and at no times shall the cooking of food be undertaken in the building without the prior agreement in writing of the Local Planning Authority.

Reason: To protect the amenity of neighbouring residential occupiers.
10) The mixed use permission hereby permitted shall extend only to the use of the premises as a family dwelling and business use for the preparation, storage and distribution of sandwiches and associated products and shall only be operated by the owner/occupiers of 7 Elm Drive and shall revert to wholly residential when such a link with the owner/occupier has ceased.

Reason: To protect the amenity of neighbouring residential occupiers.
