Conditions or Reasons for Planning Application - MB/08/02330/FULL

Conditions or Reasons:

1) The development hereby approved shall be commenced within three years of the date of this permission.

Reason: To comply with Section 91 of the Town and Country Planning Act 1990 which is designed to ensure that a planning permission does not continue in existence indefinitely if the development to which it relates is not carried out.

2) The permission shall extend only to the application as amended by plan numbers 081007 Drawing No.: 02 Rev: A; 081007 Drawing No.: 03 Rev: A; MBDC/1 Rev A received 14.1.09.

Reason: For the avoidance of doubt and to ensure that the development is implemented in accordance with the plans formally approved by the Local Planning Authority.

3) All external works hereby permitted shall be carried out in materials to match as closely as possible in colour, type and texture, those of the existing building.

Reason: To safeguard the appearance of the completed development by ensuring that the development hereby permitted is finished externally with materials to match/complement the existing building(s) and the visual amenities of the locality.

4) Prior to the relocation of the boundary fence details of its position, design and materials shall be submitted to and approved in writing with the Local Planning Authority. The works shall be completed in strict accordance with these approved details.

Reason: To safeguard the visual amenities of the locality.

5) No retained tree shall be cut down, uprooted or destroyed within 1 year of the moving of the boundary fence, without the written approval of the Local Planning Authority

If any retained tree is removed, uprooted or destroyed or dies, another tree shall be planted at the same time and that tree shall be of such a size and species, and shall be planted at such time, as may be specified in writing by the Local Planning Authority.

In this condition "retained tree" means an existing tree which is to be retained in accordance with Plan 081007 Drawing No.: 03 Rev: A.

Reason: To safeguard the existing trees on the site in the interests of visual amenity.
