Conditions or Reasons for Planning Application - CB/09/00765/FULL
Conditions or Reasons:
1) The development hereby approved shall be commenced within three years of the date of this permission.

Reason: To comply with Section 91 of the Town and Country Planning Act 1990 which is designed to ensure that a planning permission does not continue in existence indefinitely if the development to which it relates is not carried out.
2) Details of the noise insulation properties of the building structure shall be submitted to and approved in writing by the Local Planning Authority prior to the commencement of development. The development shall be implemented in accordance with those details.
Reason: To protect the amenities of adjoining residential properties.
3) To minimise noise,odour and paint particles the following shall apply:
a) No paint spraying shall be carried out except in a purpose built part of the building to which extraction and filtration equipment has been fitted;
b) Details of the extraction and filtration equipment shall be submitted to and approved in writing by the Local Planning Authority prior to the commencement of the development. The development shall be implemented in accordance with the approved details.
c) Details shall include predicted noise levels from the equipment, noise transmission loss through the building structure, predicted external noise level and existing background noise level. The spray booth shall be so enclosed and/or attenuated that noise there from does not, at any time, increase the ambient equivalent continuous noise level (LAeq) as measured in accordance with BS4142: 1997 at any adjoining or nearby residential property.
d) The equipment shall be effectively operated and maintained in accordance with the manufacturers instructions;
Reason: To protect the amenities of adjoining residential properties.
4) No materials produced as a result of site development or clearance shall be burned on site. All reasonable steps, including the dampening down of site roads shall be taken to minimise dust and litter emission from the site whilst works of construction are in progress.
Reason: To protect the amenities of adjoining residential properties.
5) All external works hereby permitted shall be carried out in materials to match as closely as possible in colour, type and texture, those of the existing building.

Reason: To safeguard the appearance of the completed development by ensuring that the development hereby permitted is finished externally with materials to match/complement the existing building(s) and the visual amenities of the locality.
6) All plant and machinery and equipment installed or operated in connection with the carrying out of this permission shall be so enclosed and/or attenuated that noise there from does not, at any time, increase the ambient equivalent continuous noise level (LAeq) as measured in accordance with BS 4142: 1997, at a point one metre external to the nearest noise sensitive building.
