Conditions or Reasons for Planning Application - CB/09/06450/FULL
Conditions or Reasons:
1) The development shall begin not later than three years from the date of this permission.
REASON: To comply with Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2) Before development begins, a landscaping scheme to include any hard surfaces and earth mounding shall be submitted to and approved in writing by the Local Planning Authority. The approved scheme shall be implemented by the end of the full planting season immediately following the completion and/or first use of any separate part of the development (a full planting season means the period from October to March). The trees, shrubs and grass shall subsequently be maintained for a period of five years from the date of planting and any which die or are destroyed during this period shall be replaced during the next planting season and maintained until satisfactorily established.
REASON: To ensure a satisfactory standard of landscaping.

3) Before the development is first occupied or brought into use, the parking scheme shown on Drawing No. 1056/09/7 shall be completed and thereafter retained for this purpose.
REASON: To ensure provision for car parking clear of the highway.
(Policy T10, S.B.L.P.R).
4) The business floorspace of the live/work unit hereby permitted, the extent of which is shown hatched black on Drawing No.1056/09/3, shall be completed in readiness for use before the residential floorspace is first occupied and the residential use shall not be commenced prior to the first use of the business floorspace.
REASON: To enable the Local Planning Authority to maintain control over the use of the building having regard to the location of the site within the green belt.
5) The business floorspace of the live/work unit hereby permitted ,shall not be used for any purpose other than as an office/studio for purposes within Class B1 of the Schedule to the Town and Country Planning (Use Classes) Order 2005 (or any order revoking and re-enacting that Order with or without modification).
REASON: To enable the Local Planning Authority to maintain control over the use of the building having regard to the location of the site within the green belt, the need to minimise traffic movements in the interests of public safety and to safeguard residential amenity.

6) The live/work unit hereby permitted shall at no time be sub-divided.
REASON: To enable the Local Planning Authority to maintain control over the building having regard to the location of the site within the green belt.
7) The residential floorspace of the live/work unit hereby permitted shall not be occupied other than by a person solely or mainly employed in the business occupying the business floorspace of that unit (including any descendants of such a person residing with him/her) or a widow or widower of such a person.
REASON: To enable the Local Planning Authority to maintain control over the use of the building having regard to the location of the site within the green belt.
8) Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 1995 (or any order revoking and re-enacting that Order with or without modification), no extensions to the buildings hereby permitted shall be carried out without the grant of further specific permission from the Local Planning Authority.
REASON: To control the external appearance of the buildings having regard to the location of the site within the green belt and in the interests of safeguarding the amenity of the area.

9) Notwithstanding the provisions of Part 1 Class E of Schedule 2 to the Town and Country (General Permitted Development) Order 1995 (or any order revoking and re-enacting that Order with or without modification), no buildings or other structures shall be erected or constructed within the curtilage of the property without the grant of further specific permission from the Local Planning Authority.
REASON: To control the development having regard to the location of the site within the green belt and in the interests of safeguarding the amenity of the area.

10) Before development begins and notwithstanding the details submitted with the application, a method statement for the proposed conversion and restoration works which shall incorporate a schedule and specification of repair works detailing all proposed works of re-alignment, repair, reconstruction and making good to the fabric of the building, including a detailed schedule of the existing structural fabric to be retained and removed, details of joining techniques for timber repairs, mortar specification and brick selection, shall be submitted to and approved in writing by the Local Planning Authority. The development shall be carried out only in accordance with the approved details.
REASON: To ensure that the proposed development is carried out in a manner which safeguards the historic character and structural integrity of the building.
11) Existing facing bricks shall be re-used as far as possible and any necessary variations shall first be approved in writing by the Local Planning Authority.
REASON: To ensure that the development is in keeping with the existing building.
(Policy BE8, S.B.L.P.R).
12) Before development begins and notwithstanding the details submitted with the application, details of the materials to be used for the external windows, doors, walls, roofs and rainwater goods (including support brackets) shall be submitted to and approved in writing by the Local Planning Authority. The development shall be carried out only in accordance with the approved details.
REASON: To ensure that the development is in keeping with the existing building.
(Policy BE8, S.B.L.P.R).
13) Before development begins and notwithstanding the details submitted with the application, the following details shall be submitted to and approved in writing by the Local Planning Authority:-
detailed drawings of the proposed new external windows and doors showing fenestration, sections, mouldings, the relationship with the external envelope of the building, and cill/head details;
details of the repaired/replacement plinth;
specification and detailing of the external wall and roof construction and associated eaves and plinth details.
The development shall be carried out only in accordance with the approved details.
REASON: To ensure that the development is in keeping with the existing building.
(Policy BE8, S.B.L.P.R).
14) Before development begins, a photographic survey of the buildings shall be undertaken and a copy submitted to the Local Planning Authority for its records.
REASON: To ensure that a record of the structure and appearance of the historic building is made and retained.
15) Notwithstanding the details shown on the submitted plans, no existing timbers shall be cut, removed or altered without the prior written approval of the Local Planning Authority.
REASON: To safeguard the historic and structural integrity of the listed building.
16) Before the premises are occupied all on site vehicular areas shall be surfaced in a manner to the Local Planning Authority's approval so as to ensure satisfactory parking of vehicles outside highway limits. Arrangements shall be made for surface water from the site to be intercepted and disposed of separately so that it does not discharge into the highway.
REASON: In order to minimise danger, obstruction, and inconvenience to users of the highway and of the premises.
17) This permission relates only to the details shown on Drawing Nos. 1056/09/1, 1056/09/2, 1056/09/3, 1056/09/4, 1056/09/5, and 1056/09/7 received 12/10/09 or to any subsequent appropriately endorsed revised plan.
REASON: To identify the approved drawings and to avoid doubt.
