Conditions or Reasons for Planning Application - CB/10/00749/FULL
Conditions or Reasons:
1) The development shall begin not later than three years from the date of this permission.
REASON: To comply with Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2) Before development begins, samples of the materials to be used for the external walls and roofs of all new buildings shall be submitted to and approved in writing by the Local Planning Authority. The development shall thereafter be carried out in accordance with the approved details.
REASON: To control the appearance of the building/s.
(Policies BE8 & H8, S.B.L.P.R).
3) Prior to the commencement of development, a Tree Protection Plan (Reference BS 5837:2005 "Trees in Relation to Construction) shall be submitted to the Local Planning Authority for approval, showing clearly the position, dimensions and build specification of protective barriers to be erected around the required Root Protection Area (RPA) for the protected Birch Trees in order to establish an effective Construction Exclusion Zone.
REASON: To ensure satisfactorily protection of rooting medium needed to sustain the satisfactory health and stability of respective root systems and to exclude plant machinery and storage materials from encroaching into the existing canopy spread of the trees.
4) Prior to the commencement of development, details shall be provided to the Local Planning Authority for approval which clearly demonstrates the use of special foundation construction for the garage. This foundation should be designed to conserve the rooting medium of the trees, without requiring any degree of excavation work or creating soil compaction of the Root Protection Area (RPA), whilst maintaining effective foundation for the type of building it is to serve. The construction of the foundation should be co-ordinated with suitable ground protection e.g. using side-butted scaffold boards laid on top of a compressible layer laid into geotextile, or supported by scaffold whilst construction is undertaken, to prevent damage to the soil structure whilst foundation construction is in progress.
REASON: To ensure a satisfactory protection of rooting medium needed to sustain the satisfactory health and stability of roots in the RPA which would otherwise be destroyed by conventionally built foundations.
5) This permission relates only to the details shown on Drawing Nos. 2009-582-100A, 2009-582-101A and 2009-582-102A received 08/04/10 or to any subsequent appropriately endorsed revised plan.
REASON: To identify the approved plans and to avoid doubt.
