Conditions or Reasons for Planning Application - CB/10/01913/FULL
Conditions or Reasons:
1) The development hereby approved shall be commenced within three years of the date of this permission.

Reason: To comply with Section 91 of the Town and Country Planning Act 1990 which is designed to ensure that a planning permission does not continue in existence indefinitely if the development to which it relates is not carried out.
2) Prior to the commencement of development details of the screening to the southern side of the external staircase shall be submitted to and agreed in writing with the Local Planning Authority and the works shall be carried out in accordance with the agreed details. The screening shall then be retained in perpetuity.

Reason: To protect the residential amenity of the neighbouring property.
3) Development shall not begin until details of the junction of the proposed vehicular access with the highway have been approved by the Local Planning Authority and the extension shall not be brought into use until the junction has been constructed in accordance with the approved details.

Reason: In order to minimise danger, obstruction and inconvenience to users of the highway and the premises.
4) Before development commences details of the signage to be used to denote the staff parking space and the means of the demarcation of the parking bays at the site frontage shall be submitted to and approved in writing by the Local planning Authority and the development shall not be brought into use until the signage and the demarcation of the parking bays has been constructed in accordance with approved details.

Reason: To provide the four defined parking bays at the shop frontage.
5) Development shall not commence until a scheme detailing provision for on site parking for construction workers for the duration of the construction period has been submitted to and approved in writing by the Local Planning Authority. The scheme shall be implemented throughout the construction period.

Reason: To ensure adequate off street parking during construction in the interests of road safety.
6) The access shall have a minimum width of 4.1m with a lateral clearance of 0.3m either side (total 4.7m) for the first 8.0m into the site measured from the highway boundary, and shall be surfaced so as to distinguish it from the forecourt of the adjoining shop premises in accordance with details to be submitted to and approved in writing by the Local Planning Authority.

Reason: In the interest of road safety and for the avoidance of doubt.
7) Before the development is brought into use the on site vehicular areas shall be constructed and surfaced in a stable and durable manner in accordance with details to be approved in writing by the Local Planning Authority for a distance of 8.0m into the site, measured from the highway boundary. Arrangements shall be made for surface water drainage from the site to be intercepted and disposed of separately so that it does not discharge into the highway.

Reason: To avoid the carriage of mud or other extraneous material or surface water from the site so as to safeguard the interest of highway safety and reduce the risk of flooding and to minimise inconvenience to users of the premises and ensure satisfactory parking of vehicles outside highway limits .
8) Before the development is brought into use all on site vehicular areas shall be surfaced in a stable and durable manner in accordance with details to be approved in writing by the Local Planning Authority. Arrangements shall be made for surface water drainage from the site to soak away within the site so that it does not discharge into the highway or into the main drainage system.

Reason: To avoid the carriage of mud or other extraneous material or surface water from the site so as to safeguard the interest of highway safety and reduce the risk of flooding and to minimise inconvenience to users of the premises and ensure satisfactory parking of vehicles outside highway limits
9) There shall be no restriction on the use of the car parking spaces (numbered 1 to 8) at the rear of the site, shown on the approved plans by occupiers of, or visitors to, any of the buildings hereby permitted.

Reason: To minimise the potential for on-street parking and thereby safeguard the interest of the safety and convenience of road users.
10) The turning space for vehicles illustrated on the approved Drawing No P02 Rev C shall be constructed before the development is first brought into use.

Reason: To enable vehicles to draw off, park and turn outside the highway limits thereby avoiding the reversing of vehicles on to the highway.
11) All plant, machinery and equipment (including fans, ducting and external openings) to be used by reason of the granting of this permission shall be so installed, maintained and operated to ensure that noise resulting from its use shall not exceed a noise rating level of 5 dBA below the existing background level when measured according to BS4142:1997, at any adjoining or nearby residential property boundary.
Reason: To protect the amenity of adjacent residential properties.
12) All external works hereby permitted shall be carried out in materials to match as closely as possible in colour, type and texture, those of the existing building.

Reason: To safeguard the appearance of the completed development by ensuring that the development hereby permitted is finished externally with materials to match/complement the existing building(s) and the visual amenities of the locality.
