1. Before development begins, the approval of the District Planning Authority shall be obtained in respect of all of the reserved matters, namely the siting, design, external appearance, means of access, and landscaping of the site. REASON: To comply with Article 3(1) of the Town and Country Planning (General Development Procedure) Order 1995. 2. a. Application for the approval of the reserved matters shall be made to the District Planning Authority within three years from the date of this permission; b. The development shall begin not later than whichever is the later of the following dates: i. five years from the date of this permission, or ii. two years from the final approval of the reserved matters or, if approved on different dates, the final approval of the last such matter to be approved. REASON: To comply with Section 92 of the Town and Country Planning Act 1990. 3. The existing trees shall along the western side boundary of the site be retained and protected in a manner to be approved in writing by the District Planning Authority and shall not be destroyed, uprooted, felled, lopped or topped without the previous written consent of the District Planning Authority. Any trees removed without such consent or dying or being severely damaged or becoming seriously diseased shall be replaced by trees of such size and species as may be agreed with the District Planning Authority. Such trees shall subsequently be maintained for a period of five years from the date of planting and any which die or are destroyed during this period shall be replaced during the next planting season and maintained until satisfactorily established. REASON: To comply with Section 197 of the Town and Country Planning Act 1990 and to safeguard existing trees on site. (Policies 8, 10, B.S.P.; NE6, BE11, S.B.L.P.; NE4, BE8, S.B.L.P.F.R.D.). 4. Before the development is first occupied or brought into use the parking spaces and accesses thereto for both the existing dwelling, No. 15 Richmond Road, and the new dwelling hereby permitted, shown on plan No. LDA/5298/1 received 31/07/00, shall be completed and thereafter retained for this purpose. REASON: To ensure provision for car parking clear of the highway. (Policies T13, S.B.L.P.; T14, S.B.L.P.F.R.D.). 5. A scheme for screen fencing and/or screen walling shall be submitted to and approved in writing by the District Planning Authority and shall be implemented before the development is first occupied. REASON: To safeguard the amenity of the area. (Policies 10, B.S.P.; BE11, S.B.L.P.; BE8, S.B.L.P.F.R.D.). 6. Before development begins, samples of the materials to be used for the external walls and roofs of all new buildings shall be submitted to and approved in writing by the District Planning Authority. REASON: To control the appearance of the building/s. (Policies 10, B.S.P.; BE11, S.B.L.P.; BE8, S.B.L.P.F.R.D.). 7. Before development begins, the position of the dwelling hereby permitted shall be pegged out on site and its position approved in writing by the District Planning Authority. REASON: To enable consideration to be given to the precise layout of the development. (Policies 10, B.S.P.; BE11, S.B.L.P.; BE8, S.B.L.P.F.R.D.). 8. Before development begins, details of the junctions of the proposed vehicular accesses with the highway shall be submitted to and approved in writing by the District Planning Authority. The new dwelling hereby permitted shall not be occupied until the junctions have been constructed in accordance with the approved details. REASON: To minimise danger, obstruction and inconvenience to users of the highway and of the premises. (Policies T4, S.B.L.P.; T1, S.B.L.P.F.R.D.). 9. Before the new access to serve No. 15 Richmond Road is brought into use, a triangular vision splay shall be provided on each side of it measuring 1.8m along the fence, wall, hedge or other means of definition of the front boundary of the site, and 1.8m into the site at right angles to the same line along the side of the new access drive. The vision splays so provided and on land under the applicant's control shall be kept free of any obstruction to visibility exceeding a height of 600mm above the adjoining footway level. REASON: To provide adequate visibility between the existing highway and the proposed access and to make the access safe and convenient for the traffic which is likely to use it/them. (Policies T4, S.B.L.P.; T1, S.B.L.P.F.R.D.). 10. Before the development is first occupied or brought into use, the proposed vehicular access to serve No. 15 Richmond Road shall be surfaced in tarmacadam or other similar durable material as may be approved in writing by the District Planning Authority for a distance of 10m into the site, measured from the highway boundary. Arrangements shall be made for surface water drainage from the site to be intercepted and disposed of separately so that it does not discharge into the highway. REASON: To avoid the carriage of mud or other extraneous material or surface water from the site into the highway so as to safeguard the interest of highway safety. 11. This permission relates only to the details shown on Drawing No. LDA/5298/1 received 31/07/00 or to any subsequent appropriately endorsed revised drawing. REASON: To identify the approved drawing and to avoid doubt. NOTE ---- In accordance with the Town and Country Planning (General Development Procedure) (England) (Amendment) Order 2000, the reason for any condition above relates to the Policies as referred to in the Bedfordshire Structure Plan 2011 (B.S.P.), South Bedfordshire Local Plan (S.B.L.P) and South Bedfordshire Local Plan First Review Deposit (and Proposed Pre-Inquiry Changes) (S.B.L.P.F.R.D.). |
