Conditions or Reasons for Planning Application - CB/12/02976/VOC
Conditions or Reasons:
1) The development hereby approved shall be commenced within three years of the date of this permission.

Reason: To comply with Section 91 of the Town and Country Planning Act 1990 which is designed to ensure that a planning permission does not continue in existence indefinitely if the development to which it relates is not carried out.
2) Before the new access driveway is brought into use, a triangular vision splay shall be provided on each side of the new access drive and shall be 2.8m measured along the back edge of the highway from the centre line of the anticipated vehicle path to a point 2.0m measured from the back edge of the footway into the site along the centre line of the anticipated vehicle path. The vision splay so described and on land under the applicants control shall be maintained free of any obstruction to visibility exceeding a height of 600mm above the adjoining footway level.

Reason: To provide adequate visibility between the existing highway and the proposed access and to make the access safe and convenient for the traffic that is likely to use it.
3) Visibility splays shall be provided at the junction of the vehicular access with the public highway before the development is brought into use. The minimum dimensions to provide the required splay lines shall be 2.4m measured along the centre line of the proposed access from its junction with the channel of the public highway and 43m measured from the centre line of the proposed access along the centre line of the channel of the public highway. The required visibility splays shall, on land in the applicant's control, be kept free of any obstruction.

Reason: To provide adequate visibility between the existing highway and the proposed access, and to make the access safe and convenient for the traffic which is likely to use it.
4) None of the dwellings hereby permitted shall be occupied until the access driveway, parking and turning areas shown on drawing number 2012/689/101A have been laid out, drained and surfaced in accordance with the details previously submitted to and approved in writing by the Local Planning Authority and those areas shall not thereafter be used for any other purpose.

Reason: To enable vehicles to draw off, park and turn clear of the highway to minimise danger, obstruction and inconvenience to users of the adjoining highway.
5) Notwithstanding the provisions of the Town and Country Planning General Permitted Development Order 1995, or any amendments thereto, the garage accommodation on the site shall not be used for any purpose, other than as garage accommodation, unless permission has been granted by the Local Planning Authority on an application made for that purpose.

Reason: To retain off-street parking provision and thereby minimise the potential for on-street parking which could adversely affect the convenience of road users.
6) Notwithstanding any provision of the Town and Country Planning (General Permitted Development) Order 1995 (or any Order revoking or re-enacting that Order with or without modification) no further window or other opening shall be formed at first floor level on the side elevations of the buildings.

Reason: To protect the amenities of occupiers of neighbouring properties.
7) Prior to the first occupation of the buildings the first floor windows in the side elevations of Plots 1,2,and 3 (shown on plan numbers 2012/689/105; 2012/689/107; 2012/689/109) of the development hereby permitted shall be fitted with obscured glass of a type to substantially restrict vision through it at all times.

Reason: To safeguard the amenities of occupiers of adjoining properties.
8) The development hereby permitted shall not be carried out except in complete accordance with the details shown on the submitted plans, numbers:

Reason: For the avoidance of doubt.
