Conditions or Reasons for Planning Application - CB/13/00252/FULL
Conditions or Reasons:
1) The development shall begin not later than three years from the date of this permission.

Reason: To comply with Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2) Notwithstanding the details submitted with the application, and prior to the commencement of development on-site, a schedule of external finishes and samples of the following external materials - roof covering, timber wall cladding, window framing and rainwater goods - shall be submitted to and approved in writing by the Local Planning Authority, and the development shall thereafter be implemented strictly in accordance with the approved details.

Reason: To ensure that the development is in keeping with the rural character and appearance of the locality.

3) The building shall only be used for the stabling of horses/ponies and related storage for private use in connection with the adjacent property at The Old School House and shall not be used for any commercial purpose including livery and teaching of equestrian skills.

Reason: To prevent inappropriate commercial use in the Green Belt and to safeguard the amenities of the Green Belt and to control the number of vehicular movements associated with the use of the stables in the interests of highway safety.

4) Prior to development, a Tree Protection Plan shall be submitted to the Local Planning Authority for approval showing the position and build specification of protective fencing, that shall be effective in excluding all construction operations, building works access, storage materials and vehicle parking for a distance of 5m radius around the adjacent Sycamore and Scots Pine trees located to the immediate northwest of the new building.

Reason: To ensure the adequate protection of adjacent trees to maintain their good health, stability and screening value.

5) Prior to development, a planting plan and planting specification shall be submitted to the Local Planning Authority for approval, showing the position of a double staggered row comprising of a native hedgerow mixture of transplants supplied at 60 to 90cm high, to be planted along the northwestern fenceline alongside the new building. The hedgerow planting shall subsequently be maintained for a period of five years from the date of planting and any which die or are destroyed during this period shall be replaced during the next planting season and maintained until satisfactorily established.

Reason:To ensure the satisfactory planting and establishment of a native screening hedge between the new building and the Whipsnade Conservation Area boundary.

6) Before development begins, the position of the stable building shall be pegged out on site and its position approved in writing by the Local Planning Authority and the development shall only be carried out in accordance with the approved details.

Reason: To enable consideration to be given to the precise layout of the development and to ensure clearance from the root protection area of the adjoining Scots Pine tree.

7) The development hereby permitted shall not be carried out except in complete accordance with the details shown on the submitted plans, numbers CBC/001 - CBC/005.

Reason: For the avoidance of doubt.
