Conditions or Reasons for Planning Application - CB/13/02715/FULL
Conditions or Reasons:
1) The proposed development, by nature of the irregular plot shape and size of plot, the excessive scale and unsatisfactory design would result in a cramped and confined form of development at odds with the surrounding properties to the detriment of the character and appearance of the area; as such the proposal is contrary to Policy DM3 of the Adopted Central Bedfordshire Core Strategy and Development Management Policies 2009.
2) The proposed development, by reason of its location, size and design does not constitute infilling within the Green Belt Infill Boundary of Aspley Guise; as such the proposal is contrary to Policy DM6 of the Adopted Central Bedfordshire Core Strategy and Development Management Policies 2009, Policy 37 of the Emerging Development Strategy for Central Bedfordshire and National Planning Policy Framework.
3) The proposed development by reason of size and siting would result in unacceptable damage and subsequent loss of trees protected by a Preservation Order to the detriment of the character and appearance of the area; as such the proposal is contrary to Policies DM14 of the Central Bedfordshire Core Strategy and Development Management Policies 2009.
4) The application contains insufficient information in the form of a complete legal agreement requiring contributions to local infrastructure, by reason of the omission of contributions for education and leisure and recreational open space for this detached family dwelling; as such the proposal is contrary to Policy CS2 of the Central Bedfordshire Core Strategy and Development Management Policies (2009) and the Central Bedfordshire Council's Adopted Supplementary Planning Guidance: Planning Obligations Strategy (2008).
