Conditions or Reasons for Planning Application - CB/13/03753/VOC
Conditions or Reasons:
1) Use of the building as an independent dwelling would be likely to intensify its use such that the existing overlooking of neighbouring properties, including No.59 and No.61/63 King Street would be increased such that the privacy and amenity of the existing and future occupants of those properties, including the proposed independent dwelling, would be adversely affected. Furthermore, it is likely that the use of the building as an independent dwelling would result in a significant and unacceptable impact on the extent of private garden/amenity area available to the occupants of 59 King Street. As such the proposal is contrary to Policy DM3 of the Central Bedfordshire Core Strategy and Development Management Policies 2009.
2) Use of the building as a self contained dwelling would result in a requirement for additional parking, for which it has not been demonstrated could be adequately accommodated. Furthermore, the existing access is substandard in terms of driver/pedestrian intervisibility and as such any intensification in use of the building would result in an increase in use of the access and the likelihood of on street parking, to the detriment of highway safety. As such the proposal is contrary to Policy DM3 of the Core Strategy and Development Management Policies 2009.
3) A satisfactory completed Unilateral Undertaking has not been submitted with the proposal in order to make financial contributions towards community and infrastructure provision in the local area. As such, the proposal is contrary to Policy CS2 of the Core Strategy and Development Management Policies, November 2009 and to Central Bedfordshire Council's Adopted Supplementary Planning Document: Planning Obligations Strategy (2009).
