Conditions or Reasons for Planning Application - CB/13/03807/FULL
Conditions or Reasons:
1) The development hereby approved shall be commenced within three years of the date of this permission.

Reason: To comply with Section 91 of the Town and Country Planning Act 1990 which is designed to ensure that a planning permission does not continue in existence indefinitely if the development to which it relates is not carried out.
2) An area of land across the whole of the site frontage to be stopped up, measuring at least 2.5m from and parallel to the nearside edge of the adjacent road carriageway shall remain as public highway and shall NOT be stopped up

Reason: For the avoidance of doubt and to provide a service margin for the public highway.
3) Notwithstanding the granting of planning permission, no enclosure of the land shall take place until such time as the highway rights over the land have been formally extinguished by a formal Stopping Up Order made under Section 247 of the Town and Country Planning Act 1980 or by the application to the Magistrates Court under Section 117 of the Highways Act 1980, after which, the fenced or other means of enclosure of the land shall ensure the provision of a triangular vision splay on each side of the access drive and shall be 2.8m measured along the back edge of the highway from the centre line of the anticipated vehicle path to a point 2.0m measured from the back edge of the highway into the site along the centre line of the anticipated vehicle path. The vision splay so described and on land under the applicants control shall be maintained free of any obstruction to visibility exceeding a height of 600mm above the adjoining verge level.
Reason: To provide adequate visibility between the existing highway and the access, and to make the access safe and convenient for the traffic which is likely to use it.
4) Notwithstanding the provisions of the Town and Country Planning (General Permitted Development Order) 1995, (or any Order revoking or re-enacting that Order with or without modification) no structure, fence, wall, or other means of enclosure shall be erected unless otherwise agreed in writing by the Local Planning Authority.

Reason: To protect the character and appearance of the area.
5) The development hereby permitted shall not be carried out except in complete accordance with the details shown on the submitted plans, numbers CBC/001; CBC/002.

Reason: For the avoidance of doubt.
