Conditions or Reasons for Planning Application - CB/13/04279/OUT
Conditions or Reasons:
1) The site lies within the South Bedfordshire Green Belt, and the proposal constitutes inappropriate development. The development is not considered as an exception site and no very special circumstances have been established in this case. The development therefore would harm the openness of the Green Belt and would conflict with the principles set out in the NPPF.
2) The development would, by reason of its excessive size particularly in relation to the plot size, result in an undesirable and unacceptable cramped form of development to the detriment of the character and appearance of the rural area and would contrast sharply with the character of the existing properties close to the application site. In this respect, the proposed development would fail to enhance the local rural distinctiveness of the area and would be harmful to the character and appearance of the open countryside and thus, would be contrary to the principles of good design set out in the NPPF, Policies 43 and 50 of the emerging Development Strategy for Central Bedfordshire and Policies BE8 and SD1 of the South Bedfordshire Local Plan Review.
3) The proposal has failed to demonstrate that there is adequate provision for a satisfactory turning space within the site to enable vehicles to enter, turn and leave in forward gear. The resultant reversing of vehicles onto or off the highway would lead to conditions of danger and inconvenience to other highway users. This would be contrary to the National Planning Policy Framework (NPPF) and Policy DM3 of the Core Strategy and Development Management Policies (2009).
4) Following the adoption of the Planning Obligations Strategy SPD on 23rd October 2009 which is applied to all applications received on or after 5th January 2010, the Council requires either a Unilateral Undertaking or an agreement under S106 of the Town and Country Planning Act 1990 be submitted with the planning application in order that new development makes commensurate contributions towards new and improved local infrastructure where that development will add to infrastructure needs and requirements. The application is not accompanied by a complete and agreed Unilateral Undertaking to comply with the requirements of the Planning Obligations Strategy and therefore fails to comply with the Central Bedfordshire Council's Adopted Supplementary Planning Guidance: Planning Obligations Strategy for Southern Bedfordshire (2009) and Policy 19 of the DSCB.
