Conditions or Reasons for Planning Application - CB/14/00840/OUT
Conditions or Reasons:
1) The site lies within the South Bedfordshire Green Belt and the proposed development would conflict with the National Planning Policy Framework (NPPF) and policy 36 of the emerging Development Strategy for Central Bedfordshire whereby, within the Green Belt, permission will not be granted except in very special circumstances for development for purposes other than agriculture and forestry,small scale facilities for outdoor sport and outdoor recreation, extension and alteration to existing buildings, limited infilling or partial redevelopment of brownfield land, mineral working, or other uses appropriate to a rural area which preserve the openness of the Green Belt. No special circumstances have been established in this case.
2) To permit the proposed development on land which is located in predominantly open countryside within the Green Belt and against a background of existing planning policies would establish a precedent whereby it would be difficult for the Local Planning Authority to resist other similar proposals elsewhere in its area.
3) The proposed development would, because of its scale and layout, be out of character with other similar properties in the locality and harmful to the visual amenities of the street scene and of nearby residents. The proposal is also outside the natural limits of the village of Totternhoe, not related to existing buildings, and would be an intrusion into the countryside, detrimental to its appearance and rural character. As such the proposal is contrary to Policy BE8 of the South Bedfordshire Local Plan, Policy 43 of the emerging Development Strategy for Central Bedfordshire and the principles of good design contained within Design in Central Bedfordshire: A Guide for Development and the National Planning Policy Framework.
4) The proposed development is located within land which is identified as being a historical orchard and a habitat of principal importance to the purpose of conserving biodiversity as defined by the emerging Development Strategy for Central Bedfordshire. The application does not contain any information on the biodiversity potential of the site nor any mitigation methods to compensate for the effects of the proposed development and therefore is contrary to the requirements of Paragraph 118 of the NPPF and policy 57 of the emerging Development Strategy for Central Bedfordshire.
5) As a result of the need for adequate sight line visibility for the proposed access, the proposal would result in the loss of a substantial amount of native hedgerow, to the detriment of the rural character and setting of the area. The proposed development is therefore contrary to national advice contained within the National Planning Policy Framework, policy BE8 of the South Bedfordshire Local Plan Review and policies 58 & 59 of the emerging Development Strategy for Central Bedfordshire.
6) The application is not accompanied by an acceptable completed legal agreement securing contributions towards existing local infrastructure. By reason of the omission of sufficient contributions for education, leisure and recreational open space, sustainable transport, the proposal is contrary to the Central Bedfordshire Council's Adopted Supplementary Planning Guidance: Planning Obligations Strategy: South (2009) and emerging Development Strategy for Central Bedfordshire, policy19.
