Conditions or Reasons for Planning Application - CB/14/03375/PAAD
Conditions or Reasons:
1) The proposed change of use is not considered to fall within the scope of permitted development under Class MB, Part 3, Schedule 2 of the Town and Country Planning (General Permitted Development) Order 1995, as amended in that it fails criterion (g) and (i) of Class MB.1 as the development is considered to result in a development that would extend beyond the external dimensions of the existing building at any given point (in this case the resultant building would be higher than the existing building) and would include work that is not set out in (i) in terms of digging down and would involve more than partial demolition necessary to carry out building operations allowed by paragraph MB.1 (i) (i). The proposal would therefore result in a new larger permanent building for residential purposes which would be harmful to the rural character of the countryside by introducing a larger domestic building in an area where the NPPF and local plan policy seeks to restrict residential development. As such the proposal would be contrary to Policy DM4 of the Core Strategy and Development Management Policies Document (2009) and the National Planning Policy Framework.
