Conditions or Reasons for Planning Application - CB/14/04092/FULL
Conditions or Reasons:
1) The development hereby permitted shall begin not later than three years from the date of this permission.

Reason: To comply with Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2) Before development/work begins and notwithstanding the details submitted with the application, details of the materials to be used for the external windows, doors, walls, roofs and rainwater goods of the proposed building/s shall be submitted to and approved in writing by the Local Planning Authority. The development/work shall be carried out only in accordance with the approved details.
Reason: To ensure that the development/work is in keeping with the existing building.
3) No development shall take place until drawings of all new and proposed replacement windows and doors to a scale of 1:10 or 1:20, together with a specification of the materials and finishes has been submitted to and approved in writing by the Local Planning Authority. Details provided shall clearly show a section of the glazing bars, frame mouldings, door panels, the position of the door or window frame in relation to the face of the wall, the depth of the reveal and arch and sill details. The development shall be carried out only in accordance with the approved details.
Reason: To ensure that the proposed development/work is carried out in a manner that safeguards the historic character and appearance of the area. (Policies 43 and 45, DSCB)
4) The development hereby approved shall not be occupied until the access and parking area indicated on the approved plan have been constructed.

Reason: In order to minimise danger, obstruction and inconvenience to users of the highway and the premises.
5) Before the new access is first brought into use, a triangular vision splay shall be provided on each side of the new access and shall measure 43m along the fence, wall, hedge or other means of definition of the front boundary of the site, and 2m measured into the site at right angles to the same line along the side of the new access drive. The vision splays so described and on land under the applicant's control shall be maintained free of any obstruction to visibility exceeding a height of 1050mm above the adjoining level.

Reason: To provide adequate visibility between the existing highway and the proposed access and to make the access safe and convenient for the traffic that is likely to use it.
6) Upon completion of the new access the existing access not incorporated in the development hereby permitted shall be stopped up by raising the existing dropped kerb and reinstating the footway/verge and highway boundary to the same line, level and details as the adjoining foot way verge and highway boundary.

Reason: To limit the number of access points onto the highway where vehicular movements can occur for the safety and convenience of the highway user.
7) The development hereby approved shall not be occupied until the access and parking area indicated on the approved plan have been constructed.

Reason: In order to minimise danger, obstruction and inconvenience to users of the highway and the premises.

9) Upon completion of the new access the existing access not incorporated in the development hereby permitted shall be stopped up by raising the existing kerb and reinstating the footway /verge and highway boundary to the same line, level and detail as the adjoining footway verge and highway boundary.

Reason: To limit the number of access points onto the highway where vehicular movements can occur for the safety and convenience of the highway user.
10) The proposed bespoke Bat Loft as shown on approved plan number b120/e must be constructed and completed prior to construction of the house hereby approved.

Reason: To ensure the safety and protection of any bats on the site.
11) A scheme shall be submitted for approval in writing by the Local Planning Authority indicating the positions, design, materials and type of boundary treatment to be erected. The boundary treatment shall be completed in accordance with the approved scheme [before the use hereby permitted is commenced before the building is occupied and be thereafter retained.

Reason: To safeguard the appearance of the completed development and the visual amenities of the locality.

12) Landscape Planting Scheme
Prior to development, a detailed landscape planting scheme shall be submitted to the Local, Planning Authority for approval, clearly showing the planting sizes, planting density, planting specification and maintenance schedule of named species of trees, shrubs and hedging, which shall be at least based on the requirements as stipulated in Section 11.0 "Proposed Tree Planting" of the "Arboricultural Report" dated December 2014 (Document Ref DPA69917-68). The planting shall be maintained for a period of 5 years until satisfactorily established, and any losses incurred during this period shall be replaced in the immediate planting season following loss.

REASON: To ensure a satisfactory standard of landscape planting, maintenance and aftercare, so to enable successful planting establishment.
13)
Implementation of Tree Protection Fencing and Temporary Protective Surface
Prior to the commencement of development activities, including demolition, all tree protection fencing and temporary protective surfacing, shall be erected and positioned in strict accordance with the tree protection plan as titled "Existing Site Layout (Tree Protection - Demolition)" prepared by DPA Arboricultural Consultants (Drawing No.DPA-69917-02 Rev C), which forms Appendix 3 of the "Arboricultural Report" dated December 2014 (Document Ref DPA69917-68). All protective fencing and protective surfacing shall remain securely in place throughout the course of demolition and development.

REASON: To ensure that retained trees are adequately protected throughout the course of demolition and development, so as to ensure the long-term good health, stability and amenity value of the retained trees.
14)
Implementation of Arboricultural Report Requirements
All arboricultural tree protection methodology and operations, as stipulated within the "Arboricultural Report" prepared by DPA Arboricultural Consultants, dated December 2014 (Document Ref DPA69917-68), shall be fully implemented in strict accordance with this document, both at pre-commencement stage, during demolition, and throughout the course of development works.

REASON: To ensure a satisfactory standard of tree retention and good arboricultural practice, so as to secure the long-term health, stability and amenity value of the retained trees.

Detailed Construction Specification of Pile and Beam Foundations
Prior to development, full specification details of the pile and beam foundation, to be used for the garage construction, shall be submitted to the Local Planning Authority for approval, and shall be designed by a fully qualified structural engineer, shall be fit for purpose, and shall protect the existing soil surface from the need to undertake any strip foundation excavation, or any lowering or raising of the existing soil levels.

REASON: To protect the structural integrity of the rooting medium from compaction damage and the rooting systems from root severance or root asphyxiation by the raising or lowering of soil levels, so as to ensure the health and stability of the root system of retained trees, in the interests of maintaining visual amenity and character of the Aspley Heath Conservation Area.
17) Arboricultural Supervision and Site Inspections
Prior to development, the Local Planning Authority shall be advised in writing, and approve of, a suitable Project Arboricultural Consultant, who shall supervise and document the installation of all tree protection measures and special precautions identified in the "Arboricultural Report" dated December 2014 (Document Ref DPA69917-68), all in accordance with Section 5.0 "Arboricultural Supervision and Site Inspection" of the "Arboricultural Report".

REASON: To ensure that the required tree protection measures are carried out in strict accordance with the report requirements, and that appropriate written records of checking and supervision are made.
18) Notwithstanding the provisions of Part 1, Class A of Schedule 2 to the Town and Country Planning (General Permitted Development) Order 1995 (or any order revoking and re-enacting that Order with or without modification), no extensions to the building hereby permitted shall be carried out without the grant of further specific planning permission from the Local Planning Authority.

Reason: To control the external appearance of the building in the interests of the amenities of the area.

19) The development hereby permitted shall not be carried out except in complete accordance with the details shown on the submitted plans, numbers b121, DPA/69917/01/B, DPA/69917/02/B, DPA/69917/0/C, b143, b120/h, b122/e, b100/e, b140/d, b141 and b142/f.

Reason: To identify the approved plan/s and to avoid doubt.
