Conditions or Reasons for Planning Application - CB/15/00018/FULL
Conditions or Reasons:
1) The development hereby permitted shall begin not later than three years from the date of this permission.

Reason: To comply with Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2) No development shall take place until full specification details of a pile and beam foundation, to be used for the front extension construction, have been submitted to and approved in writing by the Local Planning Authority for approval. The specification details shall be designed by a fully qualified structural engineer, shall be fit for purpose, and shall protect the existing ground levels from the need to undertake any strip foundation excavation, or any lowering or raising of the existing ground levels. The foundations shall be constructed in accordance with the approved details.

Reason: To protect the mature Beech tree, by maintaining the structural integrity of its rooting medium, as may be caused by compaction damage, and its rooting system from root severance or root asphyxiation, as may be caused by the raising or lowering of ground levels, so as to ensure the health and stability of the Beech tree in the interests of maintaining the safety, visual amenity and character of an important tree in the local landscape, in mitigation of its Root Protection Area being encroached into by the front extension footprint.

3) No development shall take place until details of the provision of ground protection and/or protective fencing, to be positioned to cover the Root Protection Area around the Cherry tree in the vicinity of the rear extension, have been submitted to and approved in writing by the Local Planning Authority. The details shall be based on the requirements of BS 5837 : 2012 "Trees in Relation to Design, Demolition and Construction". The ground protection and/or protective fencing shall reflect the need to provide a minimum Root Protection Area radius of 5m, measured towards the extension from the outer main trunk of the Cherry tree. The ground protection and/or tree protection fencing shall remain secured in place throughout the course of development.

Reason: To protect the Cherry tree by maintaining the structural integrity of its rooting medium, as may be caused by compaction damage, and the rooting system from root asphyxiation, as may be caused by the storage of spoil or building materials, which may be incurred from any development activity, site access, parking, plant and material storage, so as to ensure the health and stability of the root system of the Cherry tree, in the interests of maintaining the safety, visual amenity and character of a tree in the local landscape.

4) The development hereby permitted shall not be carried out except in complete accordance with the details shown on the submitted plans, numbers 001, 002 Rev A, 003, 004 Rev A, 005 Rev B, 006 Rev B, 007, 008 Rev A & 009 Rev A.

Reason: To identify the approved plans and to avoid doubt.
