Conditions or Reasons for Planning Application - CB/15/00070/FULL
Conditions or Reasons:
1) The development hereby permitted shall begin not later than three years from the date of this permission.

Reason: To comply with Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2) Before development commences a scheme for the replacement parking provision for no. 9 Moretaine Road shall be submitted to and approved in writing to the Local Planning Authority. The approved parking scheme shall be completed prior to commencement of development for the approved dwelling hereby permitted.

Reason: To provide adequate replacement off street parking
3) Before development commences details of three parking spaces measuring 2.5m x 5.0m each shall be submitted to and approved in writing by the local planning authority and the development shall not be brought into use until the parking spaces have been constructed in accordance with the approved plans

Reason: To provide adequate on site parking provision in accordance with the current guidance
4) No development shall take place until details of the materials to be used for the external walls and roofs of the development hereby approved have been submitted to and approved in writing by the Local Planning Authority. The development shall thereafter be carried out in accordance with the approved details.

Reason: To control the appearance of the building in the interests of the visual amenities of the locality.
5) No building shall be occupied until the junction of the proposed vehicular access with the highway has been constructed in accordance with the approved details with the existing north-east access within the frontage of the land to be developed, not incorporated in the access hereby approved closed in a manner to the Local Planning Authority's written approval. (See Notes to the Applicant)

Reason: In order to minimise danger, obstruction and inconvenience to users of the highway and the premises and in the interest of road safety and to reduce the number of points at which traffic will enter and leave the public highway
6) Before the access is first brought into use, a triangular vision splay shall be provided on each side of the new access drive and shall be 2.8m measured along the back edge of the highway from the centre line of the anticipated vehicle path to a point 2.0m measured from the back edge of the highway into the site along the centre line of the anticipated vehicle path. The vision splay so described and on land under the applicant's control shall be maintained free of any obstruction to visibility exceeding a height of 600mm above the adjoining footway level.

Reason: To provide adequate visibility between the existing highway and the proposed access, and to make the access safe and convenient for the traffic which is likely to use it.
7) The proposed vehicular access shall be surfaced in bituminous or other similar durable material for a distance of 5.0m into the site, measured from the highway boundary, before the premises are occupied, and any gates provided shall open away from the highway and be set back a distance of at least 5.0m from the nearside edge of the carriageway of the adjoining highway.

Arrangements shall be made for surface water drainage from the site to be intercepted and disposed of separately so that it does not discharge into the highway.

Reason: To avoid the carriage of mud or other extraneous material or surface water from the site into the highway so as to safeguard the interest of highway safety and to enable vehicles to draw off the highway before the gates are opened.
8) The windows shall accord with drawing no. JJ14-009-001RevB and as set out on the application form unless otherwise agreed in writing by the Local Planning Authority.

Reason: To safeguard the appearance of the completed development and the visual amenities of the locality.
9) The first floor bathroom/landing window/s in the side facing elevations of the development hereby permitted shall be -

obscure-glazed, and
non-opening unless the parts of the window which can be opened are more than 1.7 metres above the floor of the room in which the window is installed.

No further windows or other openings shall be formed in the side elevations.

Reason: To safeguard the amenities of neighbouring occupiers.
10) The development hereby permitted shall not be carried out except in complete accordance with the details shown on the submitted plans, numbers JJ14-009-002; JJ14-009-001 revB.

Reason: To identify the approved plan/s and to avoid doubt.
