Conditions or Reasons for Planning Application - CB/15/01610/FULL
Conditions or Reasons:
1) The development hereby permitted shall begin not later than three years from the date of this permission.

Reason: To comply with Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2) No development shall commence until all protective tree fencing as shown on the "Tree Protection and Proposed Landscaping Plan" and "Arboricultural Method Statement" (Drawing No. 140603-P-22), which forms Appendix A of the Arboricultural Report,as prepared by Tim Moya Associates (Ref No. 140603-PD-21a) has been erected in strict accordance with this plan and method statement, and this fencing shall remain securely in place throughout the course of development.

Reason: Pre commencement details are required to ensure the satisfactory protection of retained trees by creating a secure construction exclusion zone in the interests of maintaining tree health and visual amenity (Policy CS16 CSDMP)
3) No development shall commence until an Arboricultural Method Statement has been submitted to the Local lanning Authority for approval, which shall demonstrate suitable soil remediation measures around the remaining unaffected rooting area of Oak tree T85. The remediation works relating to the approved Arboricultural Method Statement shall be fully implemented before development commences.

Reason: Pre commencement details are required to ensure that the maximum consideration is given to the rooting health and efficiency of Oak tree T85 in order to compensate for encroachment into the Root Protection Area of this tree caused by the new driveway access. (Policy CS16 CSDMP)
4) All areas shown as requiring "No- Dig" Construction on the "Tree Protection and Proposed Landscaping Plan" and "Arboricultural Method Statement" (Drawing No. 140603-P-22),
which forms Appendix A of the Arboricultural Report prepared by Tim Moya Associates (Ref No. 140603-PD-21a), shall be carried out in strict accordance with the construction design
specification included in this report.

Reason: To ensure the satisfactory protection of retained trees through the adoption of acceptable construction working methods within their respective Root Protection Area's.(Policy CS16 CSDMP)
5) Prior to the completion of development, a detailed landscaped planting plan, accompanied by a planting and maintenance specification, which shall expand on the indicative planting
being shown on the "Tree Protection and Proposed Landscaping Plan" and "Arboricultural Method Statement" (Drawing No. 140603-P-22), that forms Appendix A of the Arboricultural
Report,as prepared by Tim Moya Associates (Ref No. 140603-PD-21a), shall be submitted to the Local Planning Authority for approval. The approved planting plan shall be fully
implemented during the first planting season following completion of development, and planting shall be maintained for a period of 5 years thereafter, until satisfactorily established,with any losses being replaced in accordance with the approved plan and planting specification.

Reason To ensure a satisfactory standard of landscape planting, aftercare and establishment, carried out in the interests of maintaining visual amenity and landscape character, in order to compensate for the removal of trees needed to accommodate the development.(Policy CS16 CSDMP)
6) The proposed development shall be carried out and completed in accordance with the access siting and layout illustrated on No WP3025 03-A-10 including visibility splays as indicated.

Reason:To ensure that the development of the site is completed insofar as its various parts are interrelated and dependent upon one another, and to provide adequate and appropriate access arrangements at all times.(Policy DM3 CSDMP)
7) Before the new accesses are brought into use they shall be constructed and surfaced in a stable and durable bound material for a distance of 5m into the site, measured from the highway boundary. Arrangements shall be made for surface water drainage from the site to be intercepted and disposed of separately so that it does not discharge into the highway.

Reason:To avoid the carriage of mud or other extraneous material or surface water from the site so as to safeguard the interest of highway safety and reduce the risk of flooding and to minimise inconvenience to users of the premises and ensure satisfactory parking of vehicles outside highway limits (Policy CS16 CSDMP)
8) The development hereby permitted shall not be carried out except in complete accordance with the details shown on the submitted plans, numbers Arboricultural Report,as prepared by Tim Moya Associates (Ref No. 140603-PD-21a), P-02-000, 03-A-01 P1, 03-A-02 P1, 140603-P-20, 140603-P-21, 140603-P-22, WP3025 03-A-10

Reason: To identify the approved plan/s and to avoid doubt.
