Conditions or Reasons for Planning Application - CB/15/04887/OUT
Conditions or Reasons:
1) The proposed development of up to 30 residential units would result in an unsustainable form of development given the location of the site which lies outside of any defined Settlement Envelope and isolated from acceptable public transport links and community facilities. This would be contrary to the National Planning Policy Framework (2012).
2) The development would cause harm to the character and appearance of the area by extending built development in to the countryside and due to its siting to the rear of the strong building line of High Street appear incongruous and out of character with the existing uniform grain of development and with adjoining dwellings in the locality. The visual impact of the proposed development would be exacerbated by the gradient of the land and thereby would be harmful to the visual amenities of the street scene and of nearby residents and to the character of the area. The proposal therefore fails to conform with policies CS14, CS16 & DM3 of the Core Strategy for the North of Central Bedfordshire, the Central Bedfordshire Design Guide and Section 7 of the NPPF.
3) The applicant does not control sufficient land to provide adequate visibility splays at the junction of the proposed access with the public highway. The proposed development would, therefore, be detrimental to highway safety and contrary to Policy DM3 of the Core Strategy for the North and Section 4 of the NPPF.
4) Insufficient information has been supplied with the application to determine the potential impact on protected species on the site and it has not therefore been shown that the proposed mitigation measures would be adequate to fully address the potential impact upon protected species. The application does not demonstrate that a net gain for biodiversity will be realised As such, the proposal would fail to confirm with policies CS18 & DM15 of the Core Strategy for the North and Section 11 of the NPPF.
5) The application is not accompanied by an acceptable completed legal agreement securing contributions towards providing sustainable development and affordable housing provision in accordance with the National Planning Policy Framework (NPPF). The proposal is contrary to Policy CS7 (Affordable Housing) of the Central Bedfordshire Council Core Strategy, Development Management Policies Development Plan Document (2009) and the NPPF.
