Conditions or Reasons for Planning Application - CB/16/00742/FULL
Conditions or Reasons:
1) The siting of the proposed detached dwellinghouse and its garage will be detrimental to the character and significance of the setting of Silsoe House (a non-designated heritage asset) together with the character, appearance and significance of this part of the Silsoe Conservation Area by reason of obscuring views to the principal frontage of Silsoe House, a building that positively contributes to the character and appearance of this part of the Conservation Area, from the junction of High Street and Ampthill Road. The latter together with the general cramped relationship to the impressive facade and garden context of Silsoe House and the proposed resultant alterations to the front garden to accommodate vehicle parking is considered to cause a detrimental impact upon the character and significance of the setting of Silsoe House together with the character and appearance of this part of the Silsoe Conservation Area. The proposed development would be contrary to the preservation and enhancement to the character and appearance of the Conservation Area and would be damaging and harmful to the context of Silsoe House. The harm to the significance of the non-designated heritage asset and the identified less than substantial harm to the Conservation Area as a designated heritage asset is not considered to be outweighed by the public benefit of providing two additional dwellings. Thereby the proposed development is contrary to Policies CS15, DM3 and DM13 of the Core Strategy and Development Management Policies (2009) and the National Planning Policy Framework (2012).
2) The siting of the proposal is within close proximity to and would result in the loss of protected trees which are considered to contribute positively to the character and appearance of the Conservation Area. Thereby the proposal would cause harm to the character and appearance of the Conservation Area contrary to Policies CS15, DM3, DM13 and DM14 of the Core Strategy and Development Management Policies (2009) and contrary to the National Planning Policy Framework (2012).
3) The proposed detached dwellinghouse would form a substandard dwellinghouse, harmful to the amenity and living conditions of future occupiers, whereby the windows and amenity space of the proposed dwellinghouse would not benefit from an acceptable degree of direct sun light caused by the overshadowing of a number protected trees, in conflict with Policy DM3 of the Core Strategy and Development Management Policies (2009) and the advice provided within paragraph 9 of the National Planning Policy Framework which recognises that pursuing sustainable development involves improving the conditions in which people live.
4) The proposed basement dwelling would result in a substandard dwelling, harmful to the amenity and living conditions of future occupiers, whereby the second bedroom of the proposed dwelling would not have an acceptable outlook or degree of sun light or day light, in conflict with Policy DM3 of the Core Strategy and Development Management Policies (2009) and the advice provided within paragraph 9 of the National Planning Policy Framework which recognises that pursuing sustainable development involves improving the conditions in which people live.
