Conditions or Reasons for Planning Application - CB/16/02116/FULL
Conditions or Reasons:
1) The development hereby permitted shall begin not later than three years from the date of this permission.

Reason: To comply with Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2) No development shall take place until samples of the materials to be used in the construction of the external surfaces of the development hereby permitted have been submitted to and approved in writing by the Local Planning Authority. The development shall thereafter be carried out in accordance with the approved details.

Reason: To control the appearance of the building in the interests of the visual amenities of the locality.

3) No development shall take place until a landscaping scheme to include all hard and soft landscaping and a scheme for landscape maintenance for a period of five years following the implementation of the landscaping scheme have been submitted to and approved in writing by the Local Planning Authority. The approved scheme shall be implemented by the end of the full planting season immediately following the completion and/or first use of any separate part of the development (a full planting season means the period from October to March). The trees, shrubs and grass shall subsequently be maintained in accordance with the approved landscape maintenance scheme and any which die or are destroyed during this period shall be replaced during the next planting season.

Reason: To ensure an acceptable standard of landscaping.

4) The uses hereby approved shall not commence until a scheme has been submitted for approval in writing by the Local Planning Authority indicating the positions, design, materials and type of boundary treatment to be erected which shall include acoustic fencing on the western boundary of the site. The boundary treatment shall be completed in accordance with the approved scheme before the uses commence and be thereafter retained.

Reason: To safeguard the amenities of the neighbouring occupants and the future occupiers of the buildings.
5) No development shall take place until a written scheme of archaeological investigation; that includes post excavation analysis and publication, has been submitted to and approved in writing by the Local Planning Authority. The development hereby approved shall only be implemented in full accordance with the approved archaeological scheme.

Reason: This condition is pre-commencement as a failure to secure appropriate archaeological investigation in advance of development would be contrary to paragraph 141 of the National Planning Policy Framework (NPPF) that requires the recording and advancement of understanding of the significance of any heritage assets to be lost (wholly or in part).
6) The proposed development shall not be brought into use until the new access has been located in accordance with Drawing Number 15 6948 10 Rev E and formally constructed in accordance with the Council's Standard and Specification for vehicle access.

Reason: In order to minimise danger, obstruction and inconvenience to users of the highway and the premises.
7) Before the development hereby permitted is brought into use, the scheme for parking and manoeuvring shown on Drawing No 15 6948 10 Rev E shall be laid out, drained and surfaced in accordance with details previously submitted to and approved in writing by the Local Planning Authority and those areas shall not thereafter be used for any other purpose.

Reason: To enable vehicles to draw off, park and turn clear of the highway to minimise danger, obstruction and inconvenience to users of the adjoining highway.
8) Notwithstanding details in the approved plans, no development relating to the access hereby approved shall take place until details have been submitted to and approved in writing by the Local Planning Authority of a scheme showing the provision of additional passing places along the length of the proposed access road and the development hereby approved shall not be brought into use until the passing bays have been laid out and constructed in accordance with the approved details.

Reason: In order to minimise danger, obstruction and inconvenience to users of the highway and the premises.
9) The development hereby permitted shall not be occupied or brought into use until the details of any external lighting to be installed on the site, including the design of the lighting unit, any supporting structure and the extent of the area to be illuminated, have been submitted to and approved in writing by the Local Planning Authority. The external lighting shall be installed in accordance with the approved details.

Reason: In the interests of biodiveristy of the site and its surrounding area, the impact on neighbouring amenity and the setting of nearby heritage assets.
10) Notwithstanding the details contained in the Arboricultural Survey by QUANTS environmental Ltd dated May 2015, no development relating to the access shall take place until an up to date survey of all existing trees and hedgerows on the land, with details of any to be retained (which shall include details of species and canopy spread) and the measures for their protection during the course of development has been submitted to and approved in writing by the Local Planning Authority. Details shall also take account of proposals to provide additional parking spaces required under Condition 8 of this decision notice. Such agreed measures shall be implemented in accordance with a timetable to be agreed as part of the landscaping scheme.

Reason: To ensure development does not harm the vitality of mature trees to be retained in the interests of high quality development and the character and appearance of the Conservation Area, policies DM3 and DM13 of the Core Strategy and Development Management Policies 2009.
11) No development shall take place until details have been submitted to and approved in writing by the Local Planning Authority of proposals to provide biodiversity enhancements at the site. The works shall be implemented in accordance with the approved details and shall be in place prior to the development hereby approved being brought into use.

Reason: To ensure development achieves a net gain in biodiversity in accordance with the goals of the National Planning Policy Framework.
12) The uses hereby approved shall only operate between the hours of 8 am to 8 pm Mondays to Fridays, 8 am to 6 pm on Saturdays, and not at all on Sundays and Bank Holidays.

Reason: To safeguard the residential amenity which the occupiers of neighbouring properties might reasonably expect to enjoy.

13) The development hereby approved shall not be brought into use until a detailed waste scheme for the site has been submitted to and approved in writing by the Local Planning Authority. The scheme shall include details of refuse storage and collection. The scheme shall be carried out in accordance with the approved details prior to the uses hereby approved commencing.

Reason: To ensure that development is adequately provided with waste and recycling facilities in accordance with the NPPF.
14) The development hereby approved shall not be brought into use until details have been submitted to and approved in writing by the Local Planning Authority of proposed plant and equipment to be installed to serve the buildings. Details hall include specifications of equipment and noise output data. The works shall be carried out in accordance with the approved details prior to the commencement of use.

Reason: In the interests of biodiveristy of the site and its surrounding area, the impact on neighbouring amenity and the setting of nearby heritage assets.
15) The development hereby permitted shall not be carried out except in complete accordance with the details shown on the submitted plans, numbers 15 6948 02 Rev A, 15 6948 03, 15, 6948 04, 15 6948 05, 15 6948 06 Rev B, 15 6948 07 Rev B, 15 6948 08 Rev B, 15 6948 10 Rev E, 15 6948 11, 15 6948 12, Planning Statement May 2016, Design and Access Statement May 2016, Ecological Appraisal by Quants Environmental Ltd May 2015, Dusk and Dawn Bat Surveys by Quants Environmental Ltd June 2015 and Tree Constraints Plan ref 665.01/2015.

Reason: To identify the approved plan/s and to avoid doubt.
