Conditions or Reasons for Planning Application - CB/16/03292/FULL
Conditions or Reasons:
1) The development hereby permitted shall begin not later than three years from the date of this permission.

Reason: To comply with Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2) Before development/work begins and notwithstanding the details submitted with the application, details of the materials to be used for the external windows, doors, walls, roofs and rainwater goods of the proposed building/s shall be submitted to and approved in writing by the Local Planning Authority. The development/work shall be carried out only in accordance with the approved details.

Reason: To ensure that the development/work is in keeping with the character of the Conservation Area. (Section 12, NPPF)

This pre-commencement condition is necessary in order to ensure that no unnecessary harm is caused by the commencement of development works.
3) Prior to the pre school use commencing the applicant shall submit details, to the Local Planning Authority for written approval, of a 2m acoustic fence to be installed along the boundary of the pre school playground with the neighbouring residential property to the east. The fence shall be installed and maintained in accordance with the approved details.

Reason: to protect the amenities of neighbouring residents.
4) Notwithstanding the approved plans, all new rainwater goods shall be of black painted [cast iron/aluminium] and shall be retained thereafter.

Reason: To safeguard the special architectural and historic interest of this statutorily listed building. (Section 12, NPPF)
5) Prior to occupation details of the replacement tree planting and any additional tree planting shall be submitted to and approved in writing by the Local Planning Authority. The submitted details requires the sizes and densities of planting. Trees are to be standards supplied as container grown trees. The trees shall subsequently be maintained for a period of five years from the date of planting and any which die or are destroyed during this period shall be replaced during the next planting season with others of a similar size and species.

Reason: To ensure an acceptable standard of landscaping.

6) The pre school opening hours shall be restricted to children, parents and customers between the hours of 08:00 am to 18:00 pm Mondays to Fridays, and not at all on Saturdays, Sundays and Bank Holidays.

Reason: To safeguard the residential amenity which the occupiers of neighbouring properties might reasonably expect to enjoy.

7) The development hereby permitted shall not be carried out except in complete accordance with the details shown on the submitted plans, numbers CBC/001; 428-100A; 428-101A (site plan); 428-102A; 428-103A (proposed plan); 428-104A; 428-105A (Landscaping plan); 428-107A (tree protection plan); 428-108A (proposals for redundant entrance); 428-109A (construction site plan; 428-110A; 428-111A (external works)

Reason: To identify the approved plan/s and to avoid doubt.
