Conditions or Reasons for Planning Application - CB/16/03960/FULL
Conditions or Reasons:
1) The development hereby permitted shall begin not later than three years from the date of this permission.

Reason: To comply with Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2) The outside seating area development hereby approved at The First and Last Public House, Church Street, Dunstable shall not be used for the consumption of alcohol or food after 9pm on any day without the prior agreement in writing of the Local Planning Authority.

Reason: To safeguard the residential amenity which the occupiers of neighbouring properties might reasonably expect to enjoy.

3) The outside seating area hereby approved shall be not be occupied or first brought into use until the wall adjoining the area has been completed in accordance with the approved plan, drawing no. 02 Rev A and the wall shall thereafter be retained at the approved full height.

Reason: It is essential that the wall is completed and retained in order to provide for suitable screening and noise attenuation from the use of the outside seating area to adjoining neighbouring residential dwellings in order to protect the amenity of the occupiers of those properties.

4) The development hereby permitted shall not be carried out except in complete accordance with the details shown on the submitted plans, numbers 01, 02 Rev A and 03.

Reason: To identify the approved plans and to avoid doubt.
