Conditions or Reasons for Planning Application - CB/16/04193/VOC
Conditions or Reasons:
1) The development hereby permitted shall begin not later than three years from the date of this permission.

Reason: To comply with Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2) The development shall be constructed in accordance with the materials previously approved on 10/11/16 pursuant to condition 2 attached to planning permission CB/16/01510/FULL.

Reason: To ensure that the materials proposed would reflect the envisaged appearance of the development.

3) The boundary treatment shall be completed in accordance with the details previously approved on 10/11/16 pursuant to condition 3 attached to planning permission CB/16/01510/FULL, prior to the occupation of the dwellinghouse hereby approved and be thereafter retained.

Reason: To safeguard the appearance of the completed development and the visual amenities of the locality.

4) The dwellinghouse hereby approved, shall not be occupied until a landscaping scheme to include all hard and soft landscaping and a scheme for landscape maintenance for a period of five years following the implementation of the landscaping scheme have been submitted to and approved in writing by the Local Planning Authority. The approved scheme shall be implemented by the end of the full planting season immediately following the completion and/or first use of any separate part of the development (a full planting season means the period from October to March). The trees, shrubs and grass shall subsequently be maintained for a period of 5 years from the date of the implementation and any which die or are destroyed during this period shall be replaced during the next planting season.

Reason: To ensure an acceptable standard of landscaping.

5) The tree protective fencing in accordance with the details approved in respect of condition 5 of planning permission CB/16/01510/FULL shall be erected in the positions shown on Drawing No. Appendix 3 of the Tree Survey dated Jan 2016. The approved fencing shall be maintained until all equipment, machinery and surplus materials have been removed from the site. Nothing shall be stored or placed in any area fenced in accordance with this condition and the ground levels within those areas shall not be altered, nor shall any excavation be made.

Reason: To protect the trees so enclosed in accordance with Section 8 of BS 5837 of 2012 or as may be subsequently amended.

6) The proposed dwelling shall not be occupied until the access, parking areas and turning area shown on drawing number AC/2015-07/03B have been laid out, drained and surfaced in accordance with details previously submitted to and approved in writing by the Local Planning Authority and those areas shall not thereafter be used for any other purpose.

Reason: To enable vehicles to draw off, park and turn clear of the highway to minimise danger, obstruction and inconvenience to users of the adjoining highway.

7) The proposed vehicular access shall be constructed and surfaced in a bituminous or other similar durable material as may be approved in writing by the Local Planning Authority for a distance of 10m into the site, measured from the highway boundary, before the new dwelling is are occupied. Arrangements shall be made for surface water drainage from the site to be intercepted and disposed of separately so that it does not discharge into the highway.

Reason: In order to minimise danger, obstruction and inconvenience to users of the highway and the premises.

8) Before the new access is first brought into use, the existing vehicular accesses to Nos 42 and 44 Newbury Lane which are not incorporated in the access hereby approved shall be closed in a manner to the Local Planning Authority's written approval.

Reason: In the interest of road safety and to reduce the number of points at which traffic will enter and leave the public highway.

9) Notwithstanding the provisions of the Town and Country Planning General Permitted Development Order 2015, or any amendments thereto, the garage accommodation on the site shall not be used for any purpose, other than as garage accommodation, unless permission has been granted by the Local Planning Authority on an application made for that purpose.

Reason: To retain off-street parking provision and thereby minimise the potential for on-street parking which could adversely affect the convenience of road users.

10) Notwithstanding the provisions of Part 1, Class A of Schedule 2 to the Town and Country Planning (General Permitted Development) Order 2015 (or any order revoking and re-enacting that Order with or without modification), no extensions to the dwellinghouse hereby permitted shall be carried out without the grant of further specific planning permission from the Local Planning Authority.

Reason: In the interest of the protection of the setting of the Schedule Ancient Monument.

11) Notwithstanding the provisions of Part 1 Class E of Schedule 2 to the Town and Country (General Permitted Development) Order 2015 (or any order revoking and re-enacting that Order with or without modification), no buildings or other structures shall be erected or constructed within the curtilage of the property hereby approved without the grant of further specific planning permission from the Local Planning Authority.

Reason: In the interest of the protection of the setting of the Schedule Ancient Monument.

12) The development hereby permitted shall not be carried out except in complete accordance with the details shown on the submitted plans, numbers AC/2015-07/03B (Proposed Block Plan), AC/2015-07/07C (Elevations Sheet 1 of 3), AC/2015-07/08C (Elevations sheet 2 of 3), AC/201507/09B (Elevations sheet 3 of 3), AC/2015-07/10 (Replacement Garages), AC/2015-07/04A (Ground Floor Plan), AC/2015-07/11 (Basement Floor Plan), AC/2015-07/05B (First Floor Plan), AC/2015-07/06B (Roof Plan), AC/2015-07/01A (Site Location Plan), AC/2015-07/02 (Existing Block Plan), Heritage Statement Version 1, Tree Survey, Jan 2016 & CBC/001 (Vehicle Tracking).

Reason: To identify the approved plan/s and to avoid doubt.
