Conditions or Reasons for Planning Application - CB/16/04201/FULL
Conditions or Reasons:
1) The development hereby permitted shall begin not later than three years from the date of this permission.

Reason: To comply with Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2) The installation of the utility apparatus hereby permitted including any trenching, laying and backfilling shall be carried out in full accordance with the National Joint Utilities Group (NJUG) Volume 4 'Guidelines for the Planning, Installation and Maintenance of Utility Apparatus in Proximity to Trees', within proximity to all root areas of trees.

Reason: To protect mature trees in the interest of safeguarding the character and appearance of the area, to preserve and enhance the character and appearance of the Conservation Area, the architectural and historic interests of the setting of Listed Buildings and to ensure that the public benefits of the development would outweigh the harm caused to heritage assets, in accordance with Policy CS15, DM3, DM13 and DM14 of the Core Strategy and Development Management Policies (2009) and the National Planning Policy Framework.
3) With the exception of works to trees in accordance with Condition 2 or works to trees in accordance with details of such tree works submitted to and approved in writing by the Local Planning Authority under Condition 8 of this decision notice, no works to existing trees that are protected by virtue of Section 211 of the Town and Country Planning Act 1990 (as amended) (or any Act revoking and re-enacting that Act with or without modification) that are either on or adjoining the site are permitted by this planning permission.

Reason: To define the extent of the planning permission, in the interest of safeguarding the existing trees on the site in the interests of visual amenity, the character and appearance of the Conservation Area and the Setting of Listed Buildings, in accordance with Policy CS15, DM3, DM13 and DM14 of the Core Strategy and Development Management Policies (2009) and the National Planning Policy Framework.
4) No equipment, machinery or materials shall be brought on to the site for the purposes of development until a scheme for the protection of trees, has been submitted to and approved in writing by the Local Planning Authority. The development shall be carried out in complete accordance with the approved scheme for the full period of construction of the development hereby approved.

Reason: Details are required prior to the commencement of development to protect mature trees in the interest of safeguarding the character and appearance of the area, to preserve and enhance the character and appearance of the Conservation Area, the architectural and historic interests of the setting of Listed Buildings and to ensure that the public benefits of the development would outweigh the harm caused to heritage assets, in accordance with Policy CS15, DM3, DM13 and DM14 of the Core Strategy and Development Management Policies (2009) and the National Planning Policy Framework.
5) Notwithstanding the details submitted with the application, no development shall commence until, details of the materials to be used for the external windows, doors, walls, roofs and rainwater goods of the proposed buildings shall be submitted to and approved in writing by the Local Planning Authority. The development shall be carried out only in accordance with the approved details.

Reason: Details are required prior to the commencement of development to safeguard the character and appearance of the area, to preserve and enhance the character and appearance of the Conservation Area, the architectural and historic interests of the setting of Listed Buildings and to ensure that the public benefits of the development would outweigh the harm caused to heritage assets, in accordance with Policy CS15, DM3 and DM13 of the Core Strategy and Development Management Policies (2009) and the National Planning Policy Framework.
6) The first floor windows in the western side elevation of the development hereby permitted shall be permanently fitted with obscured glass of a type to substantially restrict vision through it at all times and shall be non-opening, unless the parts of the windows which can be opened are more than 1.7m above the floor of the rooms in which the windows are installed.

Reason: To safeguard the privacy of occupiers of adjoining properties, in accordance with Policy DM3 of the Core Strategy and Development Management Policies (2009).
7) Notwithstanding the details submitted with the application, no development shall take place until a Soft landscaping scheme to include the planting of trees, has been submitted to and approved in writing by the Local Planning Authority. The approved soft landscaping scheme shall be implemented by the end of the full planting season immediately following the completion and/or first use of any separate part of the development (a full planting season means the period from October to March). The trees, shrubs and grass shall subsequently be maintained in accordance with the approved landscape maintenance scheme and any which die or are destroyed during this period shall be replaced during the next planting season.

Reason: Details are required prior to the commencement of development to ensure an acceptable standard of soft landscaping and to provide a net gain for biodiversity, in accordance with Policies DM3, CS15, CS16, DM13 and DM14 of the Core Strategy and Development Management Policies and the NPPF.
8) Notwithstanding the details submitted with the application, no development shall take place until a hard landscaping scheme to include details of all boundary walls, fences, gates, hard surfaces, edging and kerbing within the site as well as details of the interception and drainage of surface water within the site and full details of construction of any surfacing or drainage within the root protection areas of trees, have been submitted to and approved in writing by the Local Planning Authority. The dwelling hereby permitted shall not be first occupied until the approved hard landscaping has been completed in full accordance with the approved details.

Reason: Details are required prior to the commencement of development in the interest of Highway Safety, to safeguard mature trees, to safeguard the visual amenities of the locality including the character and appearance of the Conservation Area and the Setting of Heritage Assets in accordance with Policy DM3, CS15, DM14 and DM13 of the Core Strategy and Development Management Policies (2009) and the National Planning Policy Framework.
9) The development hereby permitted shall not be carried out except in complete accordance with the details shown on the submitted plans, numbers: SK01-1 Revision E; SK01-2 Revision F; and SK010B.

Reason: To identify the approved plans and to avoid doubt.
