Conditions or Reasons for Planning Application - CB/16/04222/FULL
Conditions or Reasons:
1) The development hereby permitted shall begin not later than three years from the date of this permission.

Reason: To comply with Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2) Unless otherwise agreed in writing, the development hereby approved shall be carried out in strict accordance with the material details set out in the 'Planning Statement Notes' provided by J M Bygate Design dated Nov 2016.

Reason: To control the appearance of the building in the interests of the visual amenities of the locality within the Green Belt.

3) Prior to the occupation of any dwelling on the site, a scheme for the provision of waste receptacles for each dwelling shall be submitted to and agreed in writing by the Local Planning Authority. The receptacles shall be provided before occupation takes place.

Reason: In the interest of residential amenity and to reduce waste generation in accordance with the Councils's Minerals and Waste Local Plan 2014, Policy WSP5 and the adopted SPD "Managing Waste in New Developments" (2006).
4) Both prior to and during development, all tree protection measures as stipulated in the "Arboricultural Method Statement", dated February 2016, which forms part of the "Arboricultural Report" prepared by David Clarke, and the "Tree Protection Plan" (Dwg No. TPP/FBCHMLPB/010 A) as prepared by DCCLA, shall be fully implemented in strict accordance with all recommendations.

Reason: To ensure a satisfactory standard of tree protection in order to safeguard the health, safety and stability of retained trees.

5) The landscaping scheme shown on Drawing No. 825-BR-200 together with notes detailed in the 'Planning Statement Notes' provided by J M Bygate Designs dated November 2016 landscape planting scheme shall be fully implemented during the first planting season following completion of development, and shall be maintained for a period of 5 years until satisfactorily established. Any losses incurred during this period shall be replaced during the following planting season in accordance with the approved plan.

Reason: To ensure a satisfactory standard of landscape planting and aftercare, in order to enable a planting scheme to become successfully established, in the interests of providing visual amenity within the Green Belt.

6) The development hereby approved shall not be occupied until the junctions of the proposed vehicular accesses with the highway have been implemented in accordance with the details shown on drawing number 825-BR-200.

Reason: In order to minimise danger, obstruction and inconvenience to users of the highway and the premises.

7) Before any of the accesses are first brought into use, triangular vision splays shall be provided on each side of the new access drives and shall be 2.8m measured along the back edge of the highway from the centre line of the anticipated vehicle path to a point 2.0m measured from the back edge of the footway into the site along the centre line of the anticipated vehicle path. The vision splays so described and on land under the applicant's control shall be maintained free of any obstruction to visibility exceeding a height of 600mm above the adjoining footway level.

Reason: To provide adequate visibility between the existing highway and the proposed accesses and to make the accesses safe and convenient for the traffic that is likely to use them.

8) The development hereby approved shall not be occupied until a 2.0m wide footway on the northern side of Half Moon Lane and the south-western side of Front Street shown on Drawing No. 825-BR-200 has been implemented. Any Statutory Undertakers equipment or street furniture shall be re-sited to provide an unobstructed footway.

Reason: In the interests of road safety and pedestrian movement.

9) All works relating to demolition and construction shall be undertaken in accordance with the Construction Method Statement detailed within the 'Planning Statement Notes' provided by J M Bygate Design dated November 2016 and Drawing No. 825-BR-201.

Reason: To ensure the safe operation of the surrounding road network during the construction period.

10) Prior to the occupation of the dwellings hereby approved, integral bird boxes in accordance with the specification detailed in the 'Planning Statement Notes' provided by J M Bygate Design dated November 2016 shall be incorporated within the proposed buildings and shall thereafter be retained.

Reason: To create opportunities for biodiversity within the development.

11) Notwithstanding the provisions of Part 1, Class A of Schedule 2 to the Town and Country Planning (General Permitted Development) Order 2015 (or any order revoking and re-enacting that Order with or without modification), no extensions to the buildings hereby permitted shall be carried out without the grant of further specific planning permission from the Local Planning Authority.

Reason: To control the additional extensions in the interests of preserving the openness of the Green Belt.

12) Notwithstanding the provisions of Part 1 Class E of Schedule 2 to the Town and Country (General Permitted Development) Order 2015 (or any order revoking and re-enacting that Order with or without modification), no buildings or other structures (other than those shown on the approved plans) shall be erected or constructed within the curtilage of the properties without the grant of further specific planning permission from the Local Planning Authority.

Reason: To control the development in the interests of preserving the openness of the Green Belt.

13) Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 2015 (or any order revoking and re-enacting that Order with or without modification), any garage, car port or parking space hereby permitted shall be kept permanently available for the parking of motor vehicles.

Reason: To ensure that off-street parking is retained in the interests of highway safety.

14) The development hereby permitted shall not be carried out except in complete accordance with the details shown on the submitted plans, numbers 825-BR-200, 825-BR-201, PL-01 Rev E, PL-02 Rev A, PL-03 Rev A, PL-04 Rev B, PL-05 Rev B & PL-06 Rev C.

Reason: To identify the approved plans and to avoid doubt.
