Conditions or Reasons for Planning Application - CB/16/04896/FULL
Conditions or Reasons:
1) The development hereby permitted shall begin not later than three years from the date of this permission.

Reason: To comply with Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2) No development shall take place, notwithstanding the details submitted with the application, until details of the materials to be used for the external walls and roofs of the development hereby approved, including the provision of bird boxes, have been submitted to and approved in writing by the Local Planning Authority. The approved scheme development shall thereafter be carried out in accordance with the approved details.

Reason: Building materials are required to be ordered in advance of the construction phase and to ensure that the materials proposed would reflect the envisaged appearance of the development and to ensure a net gain in biodiversity.

3) No dwelling hereby approved shall be occupied until a landscaping scheme to include all hard and soft landscaping including a landscape buffer to the northern boundary of the site which shall including nectar / berry rich planting has been submitted to and approved in writing by the Local Planning Authority. The approved scheme shall be implemented by the end of the full planting season immediately following the completion and/or first use of any separate part of the development (a full planting season means the period from October to March). The trees, shrubs and grass shall subsequently be maintained in accordance with the approved landscape maintenance scheme and any which die or are destroyed during this period shall be replaced during the next planting season.

Reason: To ensure an acceptable standard of landscaping and a net gain in biodiversity.

4) A scheme shall be submitted for approval in writing by the Local Planning Authority indicating the positions, design, materials and type of boundary treatment to be erected. The boundary treatment shall be completed in accordance with the approved scheme before the dwellings are occupied and be thereafter retained.

Reason: To safeguard the appearance of the completed development and the visual amenities of the locality.

5) The dwellings hereby approved shall not be occupied until details of the bin storage & collection areas have been submitted to and approved in writing by the Local Planning Authority and the bin storage/collection areas have been implemented in accordance with the approved details. The bin storage & collection areas shall be retained thereafter.

Reason: In the interest of amenity.

6) Development shall not begin until a scheme for protecting the proposed dwellings from noise from road traffic and noise from the village store and post office adjacent to the proposed development has been submitted and approved by the local planning authority. Any works which form part of the scheme approved by the local authority shall be completed and shown to be effective before any permitted dwelling is occupied, unless an alternative period is approved in writing by the Authority.

Reason; To protect the amenity of future occupiers and to safeguard the adjacent business activities.

7) No development approved by this permission shall take place until the following has been submitted to and approved in writing by the Local Planning Authority:

A Phase 1 Desk Study report prepared by a suitably qualified person adhering to BS 10175 and CLR 11 documenting the ground and material conditions of the site with regard to potential contamination.

Reason: To ensure that any contamination which exists on the site is identified and properly dealt with in the interests of the residential amenity of the future occupiers of the site and of the surrounding area.

7) No development approved by this permission shall take place until the following has been submitted to and approved in writing by the Local Planning Authority:

A Phase 1 Desk Study report prepared by a suitably qualified person adhering to BS 10175 and CLR 11 documenting the ground and material conditions of the site with regard to potential contamination.

Reason: To ensure that any contamination which exists on the site is identified and properly dealt with in the interests of the residential amenity of the future occupiers of the site and of the surrounding area.

8) No occupation of any permitted building shall take place until the following has been submitted to and approved in writing by the Local Planning Authority:

Where shown to be necessary by the Phase 1 Desk Study, a Phase 2 Site Investigation adhering to BS 10175 and CLR 11, incorporating all appropriate sampling, prepared by a suitably qualified person.

Where shown to be necessary by the Phase 2 Site Investigation a detailed Phase 3 Remediation Scheme (RS) prepared by a suitably qualified person, with measures to be taken to mitigate any risks to human health, groundwater and the wider environment, along with a Phase 4 validation report prepared by a suitably qualified person to confirm the effectiveness of the RS. Remediation shall be carried out in accordance with the recommendations of the approved report and following completion of remedial measures a verification report should be prepared that demonstrates the effectiveness of the remediation carried out.

Any such remediation/validation should include responses to any unexpected contamination discovered during works.

Reason: To protect human health and the environment in accordance with Policy DM3 of the Core Strategy and Development Management Policies Document (2009).
9) No development shall take place until details of a scheme for the disposal of surface water has been submitted to and approved in writing by the Local Planning Authority. The approved works shall be constructed in accordance with the approved details before the development is first occupied or brought into use.

Reason: To prevent surface water flooding and the prevention of a foul sewage being utilised for surface water drainage.

10) The dwellings hereby permitted shall not be occupied until the accesses, parking areas and turning areas shown on drawing number LBF-0006 Sheet 1 of 5 have been laid out, drained and surfaced in accordance with details previously submitted to and approved in writing by the Local Planning Authority and those areas shall not thereafter be used for any other purpose.

Reason: To provide a satisfactory means of access and to enable vehicles to draw off and park and turn clear of the highway to minimise conditions of danger, obstruction and inconvenience to users of the adjoining highway.

11) Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 2015 (or any order revoking and re-enacting that Order with or without modification), any garage, car port or parking space hereby permitted shall be kept permanently available for the parking of motor vehicles.

Reason: To ensure that off-street parking is retained in the interests of highway safety.

12) In the absence of any detailed information submitted with the planning application relating to demolition and construction, no development shall be commenced until a construction method statement has been submitted to the local planning authority. The approved statement shall include:

Loading and unloading of plant and materials;
Storage of plant and materials used in constructing the development;
Wheel washing facilities; and
Details of the responsible person who can be contacted in the event of a complaint

and all works shall be undertaken in accordance with the approved details.

Reason: To ensure the safe operation of the surrounding road network during the construction period.
13) The development hereby permitted shall not be carried out except in complete accordance with the details shown on the submitted plans, numbers LBF-0006 Sheet 1 of 5 (Site Layout Plan), LBF-0006 Sheet 2 of 5 (Plots 1 & 2), LBF-0006 Sheet 3 of 5 (Plots 3, 4 & 5), LBF-0006 Sheet 4 of 5 (Plot 6), LBF-0006 Sheet 5 of 5 (Plot 7), CBC/001 (Site Location Plan) and Sheet 1 of 1 Issue A (Topo Survey).

Reason: To identify the approved plans and to avoid doubt.
