Conditions or Reasons for Planning Application - CB/16/05457/FULL
Conditions or Reasons:
1) The development hereby permitted shall begin not later than three years from the date of this permission.

Reason: To comply with Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2) The storage container as identified on plan 16.58.01A shall be removed and the land re-instated to its former condition on or before 15th February 2022 unless, before that date, the Local Planning Authority has granted planning permission for its retention.

Reason: The container is of a temporary nature. The Local Planning Authority wishes to retain control over temporary buildings within the Green Belt to ensure they are required for their intended purpose. To ensure the openness of the Green Belt is protected from encroachment. In accordance with Section 9 of the National Planning Policy Framework.
3) No development shall take place on above ground works until samples of the materials to be used in the construction of the external surfaces of the development hereby permitted have been submitted to and approved in writing by the Local Planning Authority. The development shall thereafter be carried out in accordance with the approved details.

Reason: To control the appearance of the building in the interests of the visual amenities of the locality.

4) Before the premises are brought into use all on site vehicular areas shall be surfaced in a stable and durable materials in accordance with details to be approved in writing by the Local Planning Authority. Arrangements shall be made for surface water drainage from the site to soak away within the site so that it does not discharge into the highway or into the main drainage system.

Reason: To avoid the carriage of mud or other extraneous material or surface water from the site so as to safeguard the interest of highway safety and reduce the risk of flooding and to minimise inconvenience to users of the premises and ensure satisfactory parking of vehicles outside highway limits
5) Any gates provided shall open away from the highway and be set back a distance of at least 5.0m from the nearside edge of the carriageway of the adjoining highway.

Reason: To enable vehicles to draw off the highway before the gates are opened.
6) Notwithstanding the changes of use permitted within Part 3 of Schedule 2 of the Town and Country Planning (General Permitted Development) Order 2015 (or any Order revoking or re-enacting that Order with or without modification), the development hereby approved shall only be used as an office and storage ancillary to the Sui Generis use as a Builders Yard only, and for no other purpose.

Reason: To exclude the provisions of the said Use Classes Order and thereby ensure the Local Planning Authority retains full control of the future use of the land/building(s) in view of the special circumstances of the case. (Section 9, NPPF)
7) No works shall commence on site until the existing storage building to be demolished as identified on plan number 16.58.01A is completely removed from the site.

Reason: This application is allowed on the basis of a replacement building. The cumulative impact of an additional building retained on the site may be harmful to the openness of the Green Belt.
8) The development hereby permitted shall not be carried out except in complete accordance with the details shown on the submitted plans, numbers 16.58.01A, site plan.

Reason: To identify the approved plan/s and to avoid doubt.
