Conditions or Reasons for Planning Application - CB/16/05851/FULL
Conditions or Reasons:
1) The development hereby permitted shall begin not later than three years from the date of this permission.

Reason: To comply with Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.
2) Notwithstanding the details submitted with the application, and prior to commencement of above ground constructional phase of the development hereby approved, a full selection of external material samples, including facing and detail (window and passageway arch) brick and roof tile proposed to be installed in respect of the new development hereby approved shall be made available on site for inspection by, and written approval of, the Local Planning Authority and the approved development shall be undertaken thereafter strictly in accordance with the approved details.

Reason: To ensure that the development is carried out in a manner that safeguards the traditional character of the building and the character and appearance of the Conservation Area, and its immediate setting, in which the building is located.

3) Notwithstanding the details submitted with the application, and prior to commencement of the constructional phase of the development hereby approved, a full external finishes Schedule, including colours expressed as RAL nos. or demonstrated by colour swatches, shall be submitted to and approved in writing by the Local Planning Authority and the approved development shall be undertaken thereafter strictly in accordance with the approved details.

Reason: To ensure that the development is carried out in a manner that safeguards the traditional character of the building and the character and appearance of the Conservation Area, and its immediate setting, in which the building is located.

4) Notwithstanding the details submitted with the application, and prior to commencement of the constructional phase of the development hereby approved, a full Schedule and specification of works of external 'making good' required as a result of implementation of the development hereby approved shall be submitted to and approved in writing by the Local Planning Authority and the approved development shall be undertaken thereafter strictly in accordance with the approved details.

Reason: To ensure that the development is carried out in a manner that safeguards the traditional character of the building and the character and appearance of the Conservation Area, and its immediate setting, in which the building is located.

5) Notwithstanding the details submitted with the application, all new windows and external doors proposed to be installed as part of the development hereby approved shall be of painted timber construction, full details of which, including opening arrangements for the windows, which shall operate in the traditional manner, shall be submitted to and approved in writing by the Local Planning Authority prior to the installation of windows and / or doors on site, and the approved development shall thereafter be implemented strictly in accordance with the approved details and shall be maintained as such thereafter.

Reason: To ensure that the development is carried out in a manner that safeguards the traditional character of the building and the character and appearance of the Conservation Area, and its immediate setting, in which the building is located.

6) Notwithstanding the details submitted with the application, and prior to commencement of the constructional phase of the development hereby approved, drawn detail at an appropriate scale between 1:10 and 1:20, showing the following shall be submitted to and approved in writing by the Local Planning Authority and the approved development shall thereafter be implemented strictly in accordance with the approved details:
elevation and section details showing the relationship of the window and door installations hereby approved to the external envelope of the building including drawn examples of each of the following: -
- window with brick window head detailing
- passageway door brick arch detailing
- window with brick arch detailing, and relieving arch as appropriate
- flat roofed entrance door canopy

Reason: To ensure that the development is carried out in a manner that safeguards the traditional character of the building and the character and appearance of the Conservation Area, and its immediate setting, in which the building is located.

7) Notwithstanding the details submitted with the application, and prior to the commencement of development on site, drawn detail at an appropriate scale between 1:10 and 1:20, showing the passageway barred gate proposed to be installed, which shall be of traditional form and construction, shall be submitted to and approved in writing by the Local Planning Authority and the approved development shall thereafter be implemented strictly in accordance with the approved details:

8) Notwithstanding the details submitted with the application, the rainwater goods to be installed as part of the new development hereby approved shall be of 'Heritage Range' painted cast aluminium, full details of which shall be submitted to and approved in writing by the Local Planning Authority prior to the commencement of development on site, and the approved development shall thereafter be implemented strictly in accordance with the approved details and shall be maintained as such thereafter.

Reason: To ensure that the development is carried out in a manner that safeguards the traditional character of the building and the character and appearance of the Conservation Area, and its immediate setting, in which the building is located.

9) Before the development hereby permitted is first occupied or brought into use, the scheme for access, parking and manoeuvring shown on Drawing No 00816/6A shall be laid out, drained and surfaced in accordance with details previously submitted to and approved in writing by the Local Planning Authority and those areas shall not thereafter be used for any other purpose.

Reason: To enable vehicles to draw off, park and turn clear of the highway to minimise conditions of danger, obstruction and inconvenience to users of the adjoining highway.

10) The vehicular access driveway from Lammas Walk shall be 4.1m wide with 0.3m lateral clearance on either shall be constructed and surfaced in a bituminous or other similar durable material as may be approved in writing by the Local Planning Authority before any of the apartments hereby permitted are first occupied. Arrangements shall be made for surface water drainage from the site to be intercepted and disposed of separately so that it does not discharge into the highway.

Reason: In order to avoid the carriage of mud, gravel or other extraneous material or the discharge of surface water from the site into the highway and therefore minimise conditions of danger, obstruction and inconvenience to users of the highway and the premises.

11) Before any of the apartments hereby permitted are first occupied, a triangular vision splay shall be provided on each side of the internal access drive and shall be 2.8m measured along the back edge of the highway from the centre line of the anticipated vehicle path to a point 2.0m measured from the back edge of the footway into the site along the centre line of the anticipated vehicle path. The vision splays so described shall thereafter be kept free of all obstruction to visibility exceeding a height of 600mm above the adjoining footway level.

Reason: To provide adequate visibility between the existing highway and the proposed access and to make the access safe and convenient for the traffic that is likely to use it.

12) No development shall take place until a Phase 1 Desk Study report adhering to BS 10175 documenting the ground and material conditions of the site with regard to potential contamination has been submitted to and approved in writing by the Local Planning Authority. No occupation of any permitted building shall take place until the following have been submitted to and approved in writing by the Local Planning Authority:

Where shown to be necessary by the Phase 1 Desk Study, a Phase 2 Site Investigation adhering to BS 10175 and incorporating all appropriate sampling.

Where shown to be necessary by the Phase 2 Site Investigation a detailed Phase 3 remediation scheme with measures to be taken to mitigate any risks to human health, groundwater and the wider environment. Any works which form part of the Phase 3 scheme approved by the local authority shall be completed in full before any permitted building is occupied.

The effectiveness of any scheme shall be demonstrated to the Local Planning Authority prior to occupation by means of a validation report (to incorporate photographs, material transport tickets and validation sampling), unless an alternative period is approved in writing by the Authority. Any such validation should include responses to any unexpected contamination discovered during works.

Reason: The condition must be discharged prior to commencement to ensure that the site is suitable for its end use and to protect human health and the environment.

13) No development shall take place until a comprehensive noise survey based on current surrounding uses has been submitted to the Local Planning Authority for consideration. If shown to be required, the survey shall be accompanied by a mitigation scheme designed to deal with the findings of the acoustic assessment, which may include the windows on all facades adversely affected by industrial or commercial noise to be fixed shut in perpetuity and a ventilation strategy to deal with both purge and trickle ventilation to meet the requirements of building regulations. Development shall not commence until the scheme has been approved in writing by the Local Planning Authority. The scheme shall thereafter be implemented in full and maintained as such thereafter.

Reason: The condition must be discharged prior to commencement to ensure the protection of future occupiers of the development from unacceptable levels of noise pollution and to prevent the adjoining industrial and commercial units from being detrimentally affected by the proposed development.

14) No development shall take place until a comprehensive odour assessment survey based on current surrounding uses has been submitted to the Local Planning Authority for consideration. If shown to be required, the survey shall be accompanied by a mitigation scheme designed to deal with the findings of the odour assessment. Development shall not commence until the scheme has been approved in writing by the Local Planning Authority. The scheme shall thereafter be implemented in full and maintained as such thereafter.

Reason: The condition must be discharged prior to commencement to ensure the protection of future occupiers of the development from unacceptable levels of odour pollution and to prevent the adjoining industrial and commercial units from being detrimentally affected by the proposed development.

15) Prior to the occupation of any dwelling on the site, a scheme for the provision of the waste receptacles required for the development shall be submitted to and agreed in writing by the Local Planning Authority. The receptacles shall be provided before occupation takes place.

Reason: In the interest of residential amenity and to reduce waste generation in accordance with the Councils's Minerals and Waste Local Plan 2014, Policy WSP5 and the adopted SPD "Managing Waste in New Developments" (2006).
16) The development hereby permitted shall not be carried out except in complete accordance with the details shown on the submitted plans, numbers 00816/1A, 00816/2, 00816/3A, 00816/4, 00816/5A, 00816/6A, 00816/7 and CBC/001

Reason: To identify the approved plans and to avoid doubt.
