Conditions or Reasons:

1) The development hereby permitted shall begin not later than three years from the date of this permission.

Reason: To comply with Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.

2) The use of the site shall not commence before a scheme of sound attenuation works has been submitted to and approved in writing by the Local Planning Authority. The scheme shall demonstrate to the satisfaction of the Local Planning Authority that noise resulting from the use of the premises would not result in unacceptable living conditions for residents at existing first floor properties on High Street. The approved works shall be completed prior to the first use of the premises and shall be permanently retained and maintained thereafter.

Reason: To safeguard the amenities of neighbouring residential occupiers in accordance with Policy DM3 of the Central Bedfordshire Core Strategy and Development Management Policies (2009).

3) The premises shall not be open to customers except between 1100hrs to 2300 hrs on any day.

Reason: To protect the amenity of neighbouring residential occupiers in accordance with Policy DM3 of the central Bedfordshire Core Strategy and Development Management Policies (2009).

4) Not withstanding the Provisions of the Town and Country Planning (General Permitted Development) (England) Order 2015 or any replacement legislation, the premises shall not be used in a way that would not fall within use classes A1, A2 or A4.

Reason: To protect the amenity of neighbouring residential occupiers in accordance with Policy DM3 of the Central Bedfordshire Core Strategy and Development Management Policies (2009).

5) This planning permission relates only to the ground floor of the premises.

Reason: For the avoidance of doubt.

6) The development hereby permitted shall not be carried out except in complete accordance with the details shown on the submitted plans, numbers CBC/001 and CBC/002.

Reason: To identify the approved plans and to avoid doubt.
